WHEREAS, the Street, as described herein, is useless for the purpose for which it was laid out \-- in the plat and vacation thereof is in the interest of the public; and WHEREAS, -fifths of all members of the City Council voted in favor of this Resolution; NOW, THEREFORE, BE IT RESOLVED, that pursuant to Minnesota Statute Section 412.851: 1. That a portion of First Street (Alley) and a portion of Second Street (Second Avenue) within the plat of FIRST ADDITION TO COLE'S PLAT OF PEQUOT legally described as follows is hereby vacated: That part of the 16.00 foot alley as dedicated in the plat of FIRST ADDITION TO COLE'S PLAT OF PEQUOT, Crow Wing County, Minnesota, lying Northerly of the easterly extension of the South line of Lot 9, Block 1, said plat, and That part of the east 15.00 feet of Second Avenue, as dedicated in the plat of FIRST ADDITION TO COLE'S PLAT OF PEQUOT, Crow Wing County, Minnesota, lying Northerly of the Westerly extension of the South line of Lot 9, Block 1, said plat; and 2. The City of Pequot Lakes hereby reserves a utility and drainage easement over, under and across the vacated Streets; and 3. As a result of said vacation, the fee interest in the following property is vested in CLA Properties, LLC: That part of the east 15.00 feet of Second Avenue, as dedicated in the plat of FIRST ADDITION TO COLE'S PLAT OF PEQUOT, Crow Wing County, Minnesota, lying Northerly of the Westerly extension of the South line of Lot 9, Block 1, of said plat. 4. As a result of said vacation, the fee interest in the following property is vested as follows: The easterly 8.00 feet of that part of the 16.00 foot alley as dedicated in the plat of FIRST ADDITION TO COLE'S PLAT OF PEQUOT, Crow Wing County, Minnesota, lying Northerly of the easterly extension of the South line of Lot 9, Block 1, of said plat; vested in the name of. (to be determined based upon title work presented to the City of Pequot Lakes). The westerly 8.00 feet of that part of the 16.00 foot alley as dedicated in the plat of FIRST ADDITION TO COLE'S PLAT OF PEQUOT, Crow Wing County, Minnesota, lying Northerly of the easterly extension of the South line of Lot 9, Block 1, of said plat;
