TH 371/CR 11, RP 51.85, west side, in Pequot Lakes <br />Hearing October 6, 2009 <br />Thank you for inviting Mn/DOT to this hearing but nobody from our office will be able <br />to attend. Mn /DOT offers the following comments to this proposal: <br />If the vacate request means that the existing north end connection of First St. to <br />CR 11 will be closed, then Mn /DOT supports the request. First St. and TH 371 <br />are close together and with county road traffic at the signal this area can get <br />congested. Closing that connection will be a safety improvement. <br />- The assumed TH 371 Right of Way (RNV) line is near the east edge of the First <br />St. pavement. However, there may be some legal loose ends regarding the <br />exact location of the RAN line, and some remnant portions of lots along the east <br />side of the platted alley may or may not be part of our RNV. The city and <br />applicant will have to work with Brett Stark in Mn /DOT's R/W Office (218 -828- <br />5805) on these issues. Mn /DOT will not allow any portion of our RM to be <br />turned back, reconveyed, included in vacate area, etc.- Subject to our review, we <br />will not allow any changes to the R/W, ditch and backslope areas, and no portion <br />of the RAN may be factored into any city ponding requirements for the site. <br />No net increase in development drainage to highway R/W is allowed. If the <br />vacate is approved, any proposal to direct drainage to the RNV must be reviewed <br />by Bob Nibbe, Mn /DOT District 3 Hydraulics Engineer. Submit a detailed site <br />plan (existing and proposed contours, drainage plans) to Mn/DOT. <br />- No permanent or temporary signs, materials displays, product storage, buildings, <br />parking, septics, wells, or any other types of encroachments are allowed on the <br />highway RNV. No tree removal is allowed without a permit. <br />Mn/DOT wishes to stress that City approvals of any applicant's CUP, rezoning, or <br />building permit request does not constitute an automatic approval by Mn /DOT of an <br />Entrance Permit or other RAN work at that location. Any request involving access to <br />a state highway or work on highway RAN (new entrance request, Change in Use of <br />an existing entrance, utility work, grading, tree removal, etc.) requires Mn /DOT <br />review and permits. All applicants must contact Mn /DOT prior to any assumptions <br />on highway access or work on the RAN.
