TOS <br />`' September 30, 2009 <br />Dawn Bittner <br />Zoning Administrator <br />City of Pequot Lakes <br />4638 County Rd 11 <br />Pequot Lakes, Minnesota 56472 <br />218.568.6699 <br />RE: Notice of Public Hearing for Vacation of a Portion of First Street (Alley) and a <br />portion of Second Street (Second Avenue), Block One, First Addition to Cole's <br />Plat of Pequot, October 6, 2009 <br />Dear Ms. Bittner: <br />I am writing on behalf of Arvig Telephone Company d/b /a TDS Telecom ( "TDS ") in <br />response to the notice of public hearing on the matter referenced above. TDS will have a <br />representative at the hearing, however, we wanted to respond to you in writing as well to <br />note our concerns. <br />As a property owner in the immediate area of the proposed vacation, we are concerned <br />`-- about the potential adverse impact of the proposed vacation. The plat and adjacent <br />property related to the proposed vacation is a busy area in the City of Pequot Lakes. <br />There is a good amount of traffic and the parking in the area is used extensively by <br />patrons and employees of the local school, church, post office and nearby businesses. <br />We believe it is necessary, prior to granting the proposed vacation, the City of Pequot <br />Lakes ensure there is no disruption to the current: (i) two -way traffic flow on Second <br />Street, Main Street, First Street and surrounding streets (this would include prohibition of <br />truck parking for grocery store delivery or business purposes on the East Side of Second <br />Street outside of the 15 feet the applicant seeks to acquire by such application to vacate); <br />(ii) access to parking in and around the area except for the restriction noted in (i) above-, <br />(iii) access to local businesses; and (iv) access to the TDS manhole and connected <br />facilities on Second Street. So long as the City can ensure there will be no, or minimal, <br />disruption to the above due to such order to vacate, TDS is not opposed to the petition to <br />vacate referenced above. <br />Thank you so much for the opportunity to present our concerns.
