COUNCIL MEMBER MALECHA <br />SECONDED THE MOTION. <br />MAYOR ADAMS MOVED TO AMEND THE MOTION INDICATING THAT <br />THE VACATION IS DONE UPON ISSUANCE OF A LAND USE PERMIT <br />AND MUST BE COMPLETED WITHIN A TWO YEAR PERIOD. <br />COUNCIL MEMBER NAGEL SECONDED THE MOTION. Rezoning Request from Commercial to Downtown Mixed Use Paul Tucci <br />Oppidan, Inc. <br />This item was withdrawn from the agenda. The developer has submitted a <br />letter requesting that this be withdrawn. <br />6.2. Rezoning from Shoreland Residential to Rural Residential LeRoy <br />Tulenchik, Applicant <br />Report presented by Chuck Marohn. Chuck stated that the applicant is <br />requesting a rezoning request from Shoreline Residential to Rural <br />Residential for part of the property located at 4316 County Road 168. Mr. <br />Marohn stated the Planning Commission recommended that the request <br />for zone change be approved based on the findings of fact listed in the <br />Planning Commission Report. <br />COUNCIL MEMBER MALECHA MOVED TO APPROVE ORDINANCE <br />09 -07, AMENDING THE OFFICIAL REZONING MAP FOR THE LEROY <br />TULENCHIK PROPERTY FROM SHORELINE RESIDENTIAL TO <br />RURAL RESIDENTIAL. COUNCIL MEMBER NAGEL SECONDED THE <br />�. MOTION. MOTION CARRIED 5 -0. <br />
