City Council Minutes <br />October 6, 2009 <br />Page 7 of 12 <br />----------------------- - - - - -- <br />Mayor Adams questioned the safety in regard to trucks loading and traffic <br />safety. <br />MAYOR ADAMS MOVED TO CLOSE THE PUBLIC HEARING. <br />COUNCIL MEMBER MALECHA SECONDED THE MOTION. MOTION <br />CARRIED 5 -0. <br />Paul Sandelin questioned who would be responsible for the cost to move <br />the existing utilities in the street? Tim Houle noted that there is storm <br />sewer along Second Street which is a main city utility and there are private <br />utilities of TDS which could require an easement. Paul Sandelin <br />questioned whose responsibility it would be to install sidewalk, curb and <br />gutter if required? Paul Sandelin questioned what the City Council <br />intended to do with the vacated street. <br />Council Member Sjoblad questioned why the City would want the rest of <br />the roadway (33 feet) and questioned the long term plan? Paul Sandelin <br />indicated that there are other issues relating to the property and to the <br />actual title to the property. He stated that the City owns highway easement <br />over the properties, not fee title. <br />MAYOR ADAMS MOVED TO ADOPT RESOLUTION 09 -32 TO VACATE <br />A SECTION OF FIRST STREET, WITH THE FOLLOWING CONDITIONS <br />• THAT THE AREA BETWEEN NFK AND THE CITY ENTRANCE <br />ON NORTH SIDE WOULD BE CLOSED <br />• CURB, GUTTER, AND SIDEWALK WOULD BE INSTALLED AND <br />THE COST OF THIS WOULD BE SHARED EQUALLY BETWEEN <br />THE CITY AND NORTHERN FOOD KING UNLESS THE <br />COUNTY PAYS FOR THESE IMPROVEMENTS. <br />COUNCIL MEMBER NAGEL SECONDED THE MOTION. <br />Paul Sandelin questioned if the City intended the public to drive on the <br />street one it is vacated. He also questioned if the City should continue to <br />plow the street? <br />Kim Bolz - Andolshek stated that if the building project does not move <br />forward and the access is taken away, it would be an issue. <br />COUNCIL MEMBER RYAN MOVED TO AMEND THE MOTION TO ADD <br />THAT THE VACATION IS CONTINGENT ON PART OF A LARGER <br />PLAN NECESSITATING THE ACTUAL ISSUANCE OF A LAND USE <br />PERMIT, WITH A TWO YEAR DEADLINE FROM THE ADOPTION OF <br />
