Mr. Marohn stated the Staff Report is incorrect. Their understanding of the application <br />was that the fence would be nontransparent. The applicant indicated last month that the <br />fence would be transparent. They are now stating the north side and 20 feet in as being <br />nontransparent. Mr. Garland stated the fence will be 6 feet; there is an old glacier there <br />and it is all rocks. The fence will be placed close to the ground and the dogs won't be <br />able to dig down. Staff would also be out there. <br />Mr. Pederson stated dog escape had been brought up and asked Mr. Garland to address <br />dog escape, digging and visibility. Mrs. Garland stated that there will only be one gate in <br />the whole fence and will have concrete so they can't dig out. The only place they could <br />dig is the gate. There will always be Staff out there. <br />Mr. Pederson also stated it is heavily wooded to the east of the fence line. He advised <br />keeping that area wooded to help with the screening and potential noise. Measuring from <br />the building to the east lot line is 380 feet and is all woods. There could be a condition <br />added to have that area remain woods. There should be nontransparent screening to the <br />north. The number of dogs outside needs to be in recommendation, too. The City allows <br />dog boarding in the Rural Residential zone. Whether right or wrong, it is there. The City <br />allows barking. Excessive barking is not allowed. If there is a parking problem, the City <br />has mechanisms in place to eliminate that problem; the City can pull the CUP and shut <br />them down. He visited the site and the plans appear to limit the noise. <br />Chairman Woog stated he visited the property as well. He was surprised with the density <br />of the wooded trees. The majority of the trees are evergreens and even in winter will <br />have the same screening as this time of year. He stated he assumes the building will be <br />air conditioned and heated. Mr. Garland stated yes, and it would be insulated. Mr. Woog <br />stated to be a good neighbor it might be a good idea to screen the west side. The trees are <br />less dense on that side. Only a certain number of dogs outside at any ome time and <br />should be conditioned that Staff be outside with them. We have heard a lot of testimony <br />regarding sound and agrees with Mr. Pederson that there is a standard that has to be met. <br />He stated he appreciates all of the comments received tonight. <br />A motion was made by Mark Hallan, seconded by Tom Adams, to approve the <br />Conditional Use Permit for a Dog Boarding/Daycare Business in the Rural Residential <br />district, based on the following Findings of Fact: <br />1. The subject property is located at 5634 County Road 11 and is zoned Rural <br />Residential. <br />2. The typical hours of operation for the proposed business are between 6 A.M. and <br />10 P.M., 7 days a week. <br />3. The proposed use will primarily take place in an existing pole building and a <br />large, fenced in area. <br />4. The occupancy at any given time will be between 20 -25 dogs. <br />5. The proposed business is considered an Animal Boarding Facility and requires a <br />\.. conditional use permit in the Rural Residential Zone. <br />
