`-- As for noise, Mr. Marohn explained that the Ordinance cites MPCA standards of 60 <br />decibels during the day and 50 decibels at night, measured at the property line. The <br />owner would need to meet that. <br />Mr. Woog asked if this were an accessory use since the applicants don't live on site. Mr. <br />Marohn explained that the Ordinance was not written so that the use be an accessory use. <br />A Home Occupation is an accessory use but a boarding facility is not. <br />Mr. Pederson asked if the requirements of Section 17 -11.6 (4 -B) have been met. Mr. <br />Marohn stated they were listed in the Findings of Fact. Mr. Pederson stated the use must <br />be compatible with surrounding people and there are provisions for comfort and <br />convenience of neighbors. With the increase of barking will property values be <br />impaired? <br />When asked, Mr. Marohn stated that limiting the number of dogs outside as a condition <br />the noise threshold would be met. <br />Ken Larson stated that there had been a proposed RV camping site where the horse farm <br />is now. The residents didn't want that and it didn't get approved. He wondered what <br />recourse the residents would have if this gets approved. He was informed City Staff <br />would only need to be notified. He further stated if this request is approved he would like <br />conditions to consider changing the kennel hours and be more restrictive with outside <br />usage. He would also like a solid, higher fence and limit the number of dogs outside. <br />Mr. Larson also asked if these properties could be rezoned where this type of request <br />would not be allowed. Mr. Marohn explained the parcels could be rezoned to Forest <br />Management or Ag, their lots would be nonconforming and the use would be allowed. <br />Mr. Larson stated the Industrial Park would be more suited for this type of business. <br />Diminishing property values from kennel of barking dogs was discussed. <br />Rich Engstrom couldn't be here tonight but a member of the audience stated he is against <br />it for all of the reasons Given. <br />Rob Voss stated he would like a solid fence between his property and the kennel. If his <br />dogs see the kennel dogs that will spark barking. <br />Marty Nelson lives east of proposed kennel approximately 3/8 mile and is concerned with <br />dogs at the kennel going into heat and attracting other dogs to the area. Mrs. Garland <br />stated they have specific paperwork for the dog owners to fill out. If dogs are intact, <br />whether male or female, they will be walked on leash or separated for aggression issues. <br />For the day care there will be no dogs taken that are intact or in heat.
