City Council Minutes July 6, 2010 Page 4 of 9 It was the consensus of the Council to authorize Mike Loven to get an estimated cost to improve the approximate % mile on North Sleutter Road. 6. Planning and Zoning Report 6.1. Virgil Dahl Dawn Bittner presented the report. Dawn explained that the Planning Commission is recommending that the City move forward with prosecution of zoning violations. Virgil Dahl addressed the Council and stated that he has heard that people are driving by and complaining about his property. He stated that he has asked Dawn and the Police Chief not to come onto his property. He stated that they took pictures without permission. Mr. Dahl stated that he was injured and has no help to clean up the property. He stated that he will be receiving another injury check and will be able to clean the whole place up. Scott Pederson, Planning Commissioner, stated that he lives near Mr. Dahl. He explained that this is not a neighborhood versus Virgil issue. He explained that there have been people complaining about the property at Planning Commission meetings and at Board of Review meetings. He stated that the neighbors would like the City to follow through to get the property cleaned up. COUNCIL MEMBER MALECHA MOVED TO AUTHORIZE THE CITY TO MOVE FORWARD WITH PROSECUTION OF THE PLANNING AND ZONING VIOLATIONS. COUNCIL MEMBER SJOBLAD SECONDED THE MOTION. MOTION CARRIED 5 -0. 6.2.A. Ordinance Amendment Regarding Retail Uses Chuck Marohn reviewed the staff report. He explained that the purpose of the ordinance is to include retail use in the land use matrix. He stated that the Planning Commission recommended approval of the ordinance amendment. MAYOR ADAMS MOVED TO ADOPT ORDINANCE 10 -08 AMENDING CHAPTER 17 OF THE CITY CODE RELATING TO THE DEFINITION OF RETAIL USE. COUNCIL MEMBER MALECHA SECONDED THE MOTION. MOTION CARRIED 5 -0. � 6.2.B.
