City Council Minutes <br />July 6, 2010 <br />Page 3 of 9 <br />Del Anderson stated that those who signed the petition would like <br />the road improved and would also like the road turned over to the <br />City. <br />Tim Houle summarized the state statute process regarding special <br />assessment procedures. He stated that the Council needs to first <br />decide if it wants Wildlife Trail to be a city street and then determine <br />if the petition is valid. If the Council concurs with these two points <br />then the state statute requires a competent person or engineer to <br />put together a study. <br />The Mayor questioned how the City would pay for the feasibility <br />study if the City decides to move forward with the project and the <br />residents decide they want to decline. Council Member Sjoblad <br />asked the property owners present if they would reimburse the City <br />for the cost of the study if it did not move forward. The property <br />owners indicated they would pay the City for the study. <br />Council Member Ryan questioned if there was any part of Sleutter <br />that is paved. Council Member Ryan stated that this should be <br />looked at as a larger project which could include North Sleutter. Tim <br />Houle noted that according to Statute, the Council must accept the <br />petition for Wildlife Trail as is and if the Council wants to pursue a <br />larger project, it must initiate the project with a 4 /5t" vote or have <br />the residents on Sleutter present a petition for the project. The <br />question was raised whether the City could do an assessment <br />project on a road that the City does not fully own. Mike Loven <br />stated that the west side of the road is in Cass County and the two <br />major property owners are the state and the county. <br />Council Member Sjoblad asked Del Anderson if he would contact <br />the owners on North Sleutter that are on the City's side of the road <br />and ask if they would initiate a petition to have the road improved. <br />Del Anderson indicated that he would contact the property owners. <br />COUNCIL MEMBER SJOBLAD MOVED THAT ACQUIRING <br />WILDLIFE TRAIL IS IN THE BEST INTEREST OF THE CITY AND <br />MOVED TO ADOPT RESOLUTION 10 -17 DECLARING <br />ADEQUACY OF PETITION AND ORDERING PREPARATION OF <br />REPORT FOR IMPROVEMENTS TO WILDLIFE TRAIL. COUNCIL <br />MEMBER RYAN SECONDED THE MOTION. MOTION CARRIED <br />5 -0. <br />MR <br />
