Mr. Burslie stated the suggested ordinance <br /> amendment puts more teeth into our existing ordinance. <br /> Planning Commission Member Birch stated if the language from the Staff Report is <br /> added, nearly every home would be in violation and potentially subject to enforcement. <br /> This is written for people to be bitter with one another and with city government for ; <br /> over regulation. � <br /> � <br /> Planning Commission Member Leckband inquired what the process is when a complaint <br /> is received. Bittner explained the documentation, correspondence, etc. <br /> Chair Hallan stated some violations have been on the list for years. If we make changes <br /> to the ordinance now,we can always revisit it in the future if we find we have problems <br /> with it. <br /> When asked by Staff, Planning Commission Member Birch stated the proposed <br /> language in red is too inclusive, not just the suggested language in the Staff Report. <br /> Mr. Burslie euplained the Attorney is looking for something that is defensible. There are <br /> some ongoing issues that we have no language to support it. Staff is recommending it be <br /> approved. Mr. Burslie reminded the Planning Commission that if this does become an <br /> issue the ordinance can always be amended. <br /> Public comment opened: <br /> Laura Leckband, Certified Building Inspector. She had worked for the City of Brainerd <br /> as a Maintenance Officer. There is an International Property Maintenance Code with <br /> years of legal precedent. We could adopt and modify that. An Administrative Citation <br /> was used for enforcement. When asked, Staff stated the City does have an <br /> Administrative Citation ordinance, although it has not been used in the past. Staff <br /> informed Mrs. Leckband that is a different agenda item,but we cannot do what <br /> Brainerd did. We are a statutory city while Brainerd is a charter city.
