Applicant was not present. <br /> Public comment opened: <br /> No public comment. <br /> Public comment closed. <br /> Chair Hallan stated the declaration is very clear regarding Outlot A. No comments have <br /> been received from the DNR or other property owners. Planning Commission Member <br /> Leckband asked who is maintaining the Outlot now. Mr. Burslie stated the developer is <br /> responsible as the owner now. <br /> A motion was made by Planning Commission Member Wilson, seconded by <br /> Planning Commission Member Birch,to recommend the Council approve <br /> the Final Plat of Charliewood,based on the following Findings of Fact: <br /> i. The applicant has complied with Conditions 2 and 4 placed on the Preliminary <br /> Plat approval as both are included in the Declaration. <br /> 2. As easement has been created for the storm drain located between Lot i and Lot 2 <br /> and is shown on the Final Plat. Maintenance of this storm drain is addressed in <br /> the Declaration. <br /> 3. The Final Plat agrees with the Preliminary Plat. The design has not changed <br /> since Preliminary Plat approval. <br /> 4. The review by the City Attorney is pending. <br /> 5. There are no public improvements or improvements that will ultimately become <br /> public. Therefore,the City Engineer has not reviewed or commented directly on <br /> the Final Plat. <br /> 6. In a letter dated March 23, 2oi8 from Maureen Hayes, Minnesota Licensed Land <br /> Surveyor, #43805,indicates the Final Plat agrees with the Preliminary Plat. <br /> �. The applicant has paid the Park Dedication Fee of$4,680. <br /> And subject to the following Condition: <br /> i. All documents must be acceptable to the City Attorney prior to Council approval <br /> of this Final Plat. <br /> All members voted"aye".
