Ms. Brown stated that she would like to see Pequot Lakes without electronic signs. The <br />L-- ordinance would need to be changed to allow this. There are a lot of unsightly reader <br />boards out there. <br />Mr. Marohn stated that as Staff he has been very clear from the beginning that this would <br />be an issue. <br />A motion was made by Tom Woog, seconded by Deb Brown, to deny the electronic <br />reader board. ROLL CALL VOTE: Mr. Habein: Nay; Ms. Brown: Aye; Mr. Pederson: <br />Nay; Mr. Woog: Aye. Motion fails — 2 Aye, 2 Nay. <br />Councilman Nagel stated he feels bad as the City has tried to be user friendly and <br />encouraging to entrepreneurship. <br />A motion was made by Scott Pederson, seconded by Bill Habein, to approve the <br />electronically lit reader board with the stipulation it can change once per day per 12 hour <br />period and can only be on during business hours. Chairman Woog called for the vote: 2 <br />Aye, 2 Nay. Motion fails. <br />A motion was made by Deb Brown, seconded by Scott Pederson, to table the digital <br />reader board until next month. All members voted "aye ". Motion carried. <br />When asked by Mr. Kaneski, Mr. Marohn stated that the lighting plan meets the intent of <br />`.. the approval in March. <br />APPLICANT: David Kennedy <br />Applicant requests a Conditional Use Permit for a Home Occupation <br />Mr. Marohn explained the Staff Report. Applicant was not present. Mr. Marohn <br />explained that Staff had contacted Mr. Kennedy in writing asking how he wished to <br />proceed and received no response from Mr. Kennedy. The written comment from James <br />Neuman was entered into the record. <br />Mr. Habein stated that Mr. Kennedy had called him that afternoon at 4:30 and stated if <br />his request was not going to be approved, he would like it tabled. The neighbors have <br />concerns with the covenants. <br />A motion was made by Scott Pederson, seconded by Bill Habein, to approve the <br />Conditional Use Permit for a Home Occupation as the City technically doesn't have <br />jurisdiction over the covenants presented to us, based on the following Findings of Fact: <br />1. All proposed business activities are proposed to be inside buildings. <br />2. The use of the property as a residence will remain the primary use. The area <br />devoted to business operations will be incidental to the structure. <br />3. The operation will be entirely within the structure.
