City Council Minutes <br />February 1, 2010 <br />Page 3 of 8 <br />• The liquor store would be the primary funding for the investment. <br />• With regard to the current liquor ordinance allowing two licenses, requested a <br />formal letter from the Council stating this Council has no intention of making <br />changes to the ordinance or making variances to it; requested confirmation that if <br />the other existing license were to be turned back to the City, the City will not <br />issue it to a new entity; and urge future Councils not to amend the off -sale <br />ordinance or offer variances to it out of respect to BLMM. <br />• Amend current liquor ordinance by adding the following: (1) 1/3 mile radius <br />from any off -sale establishment to another; (2) include language from Minnesota <br />Statute 340A.413 for first class cities to not offer more than 1 license for each <br />5,000 of population. <br />• It may take time to amend the ordinance and requests a short term moratorium <br />while the ordinance is amended. <br />MAYOR ADAMS MOVED TO TO INCLUDE THE FOLLOWING ITEMS <br />IN THE PROPOSED LIQUOR ORDINANCE AMENDMENT: <br />• THAT THE CITY WILL NOT ISSUE ADDITIONAL OFF SALE <br />LIQUOR LICENSES OVER THE CURRENT TWO UNTIL SUCH <br />TIME AS THE CITY POPULATION EXCEEDS 5000 <br />• THAT NO OFF -SALE LICENSE BE GRANTED AND PREMISES <br />LOCATED WITHIN A 1/3 MILE RADIUS OF ANOTHER OFF - <br />SALE LICENSE. <br />COUNCIL MEMBER RYAN SECONDED THE MOTION. MOTION <br />CARRIED 5 -0. <br />5.4 Liquor Ordinance Amendments — <br />City Attorney Sandelin stated he reviewed the existing liquor ordinance at the <br />City Clerk's request to look at provisions for events held outside. On sale <br />licenses are issued for contiguous spaces, not outside. Temporary licenses have <br />been issued to cover these events. He has added draft language for Temporary <br />Expansion for Council review. <br />Number 6, Annual Limit of temporary expansion licenses— restricting the number <br />of events per calendar year to two may be too restrictive. It was the consensus of <br />the Council to remove the Annual Limit. <br />Number 5, Sunday On -Sale — requiring seating capacity of 30 persons. There <br />may be smaller establishments who may want an on -sale license but may not hold <br />30 people. Mr. Sandelin stated that number may be tied to State Statute and he <br />will look into that. <br />
