M City Council Minutes February 1, 2010 Page 4 of 8 COUNCIL MEMBER RYAN MADE A MOTION TO ADOPT ORDINANCE 10 -03 RELATING TO LIQUOR LICENSES WITH THE REMOVAL OF THE REFERENCE TO THE NUMBER OF TEMPORARY EXPANSION LICENSES ALLOWED. COUNCIL MEMBER NAGEL SECONDED THE MOTION. MOTION CARRIED 5 -0. COUNCIL MEMBER RYAN MOVED TO APPROVE SUMMARY PUBLICATION OF ORDINANCE 10 -03 RELATING TO LIQUOR LICENSES. COUNCIL MEMBER NAGEL SECONDED THE MOTION. MOTION CARRIED 5 -0. 5.5 TH 371 Mill and Overlay Project — City Attorney Sandelin explained the City has received notice of a MN/DOT improvement project that will alter the access at First Street and CSAH 11. The project was originally scheduled for 2012 and could be constructed in 2010 should stimulus money be obtained. MN/DOT does not need municipal consent; they are seeking input from the City. COUNCIL MEMBER SJOBLAD MOVED TO WRITE A LETTER OF SUPPORT TO MN/DOT FOR THE CLOSURE OF THE ACCESS AT �-' FIRST STREET AND CSAH 11. COUNCIL MEMBER MALECHA SECONDED THE MOTION. Northern Food King has not moved forward with redevelopment plans. There will be maintenance issues with closing First Street. Public Works Supervisor Loven stated the street could be a dead end and plow snow straight in and back out. He also stated it would be more beneficial to NFK than as a city street; he suggested giving it to NFK and SuperAmerica and the City would not have the maintenance issues. When asked, longtime area resident Jack Schmidt stated that intersection has been a safety issue for many years. He suggested that NFK will benefit from the added property. It was suggested that rather than closing the access, there may be a better design that wouldn't require it be closed, such as a one -way street. MOTION CARRIED 5 -0. 6.
