City Council Minutes <br />February 1, 2010 <br />Page 2 of 8 <br />-------------------------------- <br />5. Presentations: <br />5.1. Call Public Hearing to Vacate a portion of Front Street — <br />City Attorney Sandelin explained the street vacation request. A sketch drawing <br />has been provided by the City Engineer as well as the legal description. The road <br />vacation statute requires the City to adopt a resolution to set a public hearing for <br />the vacation. This is a City initiated vacation and would need a 4/5 vote. There <br />will not be enough Council Members at the March Council meeting and Mr. <br />Sandelin recommends setting the public hearing date for the April Council <br />Meeting. The mailed public hearing notices should be sent to Ms. Rathcke, the <br />City and the property owners along Front Street south of the proposed vacation. <br />COUNCIL MEMBER NAGEL MOVED TO ADOPT THE RESOLUTION <br />10 -07 SETTING A PUBLIC HEARING REGARDING VACATION OF A <br />PORTION OF FRONT STREET AT THE APRIL COUNCIL MEETING. <br />COUNCIL MEMBER SJOBLAD SECONDED THE MOTION. MOTION <br />CARRIED 5 -0. <br />5.2 TDS Easement — Fiber Optic Transmission Line — <br />City Attorney Sandelin explained that TDS is making a request for an easement <br />`-' from the City. A copy of the deed is included in the packet as well as the staking <br />sheet indicating the location of the utility line. Bergquist Drive is a dedicated <br />street and the utility would be within the right -of -way. <br />COUNCIL MEMBER MALECHA MOVED TO AUTHORIZE THE <br />MAYOR AND CLERK TO EXECUTE THE DEED. COUNCIL MEMBER <br />SJOBLAD SECONDED THE MOTION. MOTION CARRIED 5 -0. <br />5.3 Oasis Mall Revitalization Project — <br />City Attorney Sandelin explained that a letter from the property owner is included <br />in the Council packet. The current liquor ordinance provides for 2 liquor licenses. <br />He cautioned the Council to think carefully before entering into an agreement. <br />The property owner is requesting the Council establish distance limitations for <br />off -sale licenses which is within the City's discretion to do so. The City would <br />need to amend the ordinance. Distances from churches and schools are currently <br />included in the ordinance. <br />Brian Laudenbach, one of the partners of BLMM that owns Oasis Mall, made the <br />following presentation: <br />• They plan to raise the entire building and replace with new construction of a <br />Dairy Queen, Laundromat, liquor store and convenience store, a two million <br />dollar project. <br />
