JULY 6, 2010 PEQUOT LAKES CITY COUNCIL MINUTES <br /> 5.1. Petition for Road Improvements(Wildlife Trail) <br /> The Clerk explained that the City has received a petition for road improvements to <br /> Wildlife Trail consisting of ditching,graveling, and paving the street to city standards <br /> and to dedicate the street to the City.The petition contains 42.1% percent of property <br /> owners' signatures. <br /> The Clerk noted that the City Engineer has submitted a proposal to prepare a report for <br /> this proposed project should the Council decide to move forward with this request. <br /> Del Anderson stated that those who signed the petition would like the road improved <br /> and would also like the road turned over to the City. <br /> Tim Houle summarized the state statute process regarding special assessment <br /> procedures. He stated that the Council needs to first decide if it wants Wildlife Trail to <br /> be a city street and then determine if the petition is valid. If the Council concurs with <br /> these two points then the state statute requires a competent person or engineer to put <br /> together a study. <br /> The Mayor questioned how the City would pay for the feasibility study if the City <br /> decides to move forward with the project and the residents decide they want to decline. <br /> Council Member Sjoblad asked the property owners present if they would reimburse the <br /> City for the cost of the study if it did not move forward.The property owners indicated <br /> they would pay the City for the study. <br /> Council Member Ryan questioned if there was any part of Sleutter that is paved. Council <br /> Member Ryan stated that this should be looked at as a larger project which could <br /> include North Sleutter.Tim Houle noted that according to Statute,the Council must <br /> accept the petition for Wildlife Trail as is and if the Council wants to pursue a larger <br /> project, it must initiate the project with a 4/5th vote or have the residents on Sleutter <br /> present a petition for the project.The question was raised whether the City could do an <br /> assessment project on a road that the City does not fully own. Mike Loven stated that <br /> the west side of the road is in Cass County and the two major property owners are the <br /> state and the county. <br /> Council Member Sjoblad asked Del Anderson if he would contact the owners on North <br /> Sleutter that are on the City's side of the road and ask if they would initiate a petition to <br /> have the road improved. Del Anderson indicated that he would contact the property <br /> owners. <br /> COUNCIL MEMBER SJOBLAD MOVED THAT ACQUIRING WILDLIFE TRAIL IS IN THE BEST <br /> INTEREST OF THE CITY AND MOVED TO ADOPT RESOLUTION 10-17 DECLARING <br /> ADEQUACY OF PETITION AND ORDERING PREPARATION OF REPORT FOR <br /> IMPROVEMENTS TO WILDLIFE TRAIL. COUNCIL MEMBER RYAN SECONDED THE <br /> MOTION. MOTION CARRIED 5-0. <br />
