Applicant requests a Variance to Construct an Addition on a Non- <br /> Conforming Structure <br /> Mr. Burslie explained the Staff Report. Applicant was present. Mr. Burslie stated the <br /> proposed patio encroached on the side yard setback. <br /> Mr. Burslie also noted a Type I Subsurface Sewage Treatment System (SSTS) had been <br /> installed in 20oo and would like to add the following Finding of Fact: <br /> lo. There was a Type I SSTS installed in 2000 sized for a 4 bedroom dwelling. <br /> The applicant stated the patio would not need to be in the setback; it could be moved so <br /> it was not encroaching the setback. <br /> Mr. Burslie stated he would like to change Finding of Fact #4: <br /> 4. The proposed patio would be constructed within the building envelope of the <br /> property. <br /> Public Comment: None. <br /> A motion was made by Planning Commission Member Wilson, seconded by <br /> Planning Commission Member Hallan, to approve the Variance to construct <br /> an addition to a Non-conforming Structure,based on the following io <br /> Findings of Fact: <br /> 1. The subject property is located at 27499 West Twin Lake Drive and is in the <br /> "Rural Residential"zone. <br /> 2. The property contains a dwelling and a shed. <br /> 3. Applicant proposes to construct a 1,989 square foot addition to the existing <br /> dwelling that would include a bedroom, a bathroom,laundry area, expand the <br /> living room and an attached garage. <br /> 4. The proposed patio would be constructed within the building envelope of the <br /> property. <br /> 5. The applicant has established that there are practical difficulties in complying <br /> with the Code as the non-conformity was not created by the applicant. <br /> 6. The deviation from the Code will still be in harmony with the general purposes <br /> and intent of the City Code and Comprehensive Plan. <br /> 7. The Variance will not create a land use not permitted in the Rural Residential <br /> zone. <br /> 8. The subject property is surrounded by Rural Residential and Shoreline <br /> Residential development. The Variance will not alter the essential character of <br /> the locality of the subject property. <br /> 9. The Variance does not appear to be for economic reasons alone and reasonable <br /> use of the property seems to exist under the Code. <br /> lo.There was a Type I SSTS installed in 2000 sized for a 4 bedroom dwelling. <br /> All members voted"aye".
