CityCouncil Special Meeting Minutes <br /> June 6, 2017 <br /> Page 3 of 4 <br /> violation of the Letter of Agreement between him and the City and Mr. <br /> Dahl stated that he is not going to clean up his property any more as he <br /> feels he is in compliance. Ms. Malecha noted there have been numerous <br /> complaints on this property. <br /> Mayor Adams closed the public hearing. <br /> City Attorney Scott explained the photographs taken of this property are <br /> not as detailed due to the configuration of the property and the property <br /> owner's denial of allowing City Staff to take pictures onsite. City Attorney <br /> Scott explained the recommendation is to pass the resolution ordering that <br /> compliance be achieved by July 7, 2017 and if not achieved the City will <br /> institute a court proceeding to get permission to enter the property to <br /> abate the conditions and assess the cost to the property owner. <br /> COUNCIL MEMBER AKERSON MOVED TO ADOPT RESOLUTION 17- <br /> 18 FINDINGS, CONCLUSIONS AND ORDER OF THE PEQUOT LAKES <br /> CITY COUNCIL REGARDING ALLEGED CODE VIOLATIONS AND <br /> NUISANCE CONDITIONS AT 3952 COUNTY ROAD 17. COUNCIL <br /> MEMBER SWANSON SECONDED THE MOTION. MOTION CARRIED <br /> 3-0 <br /> Council Member Swanson questioned how long it will take to get this <br /> property cleaned up. City Attorney Scott noted that an August timeframe <br /> for City Staff to enter the property is realistic. <br /> 3.C. 30892 South Heath Street <br /> City Attorney Scott explained that the property located at 30892 South <br /> Heath Street is considered a hazardous property situation due to unsafe <br /> buildings which are a threat to public health and safety. City Attorney <br /> Scott noted the property owner of record is David E. Clark who is <br /> deceased and City Staff has been unable to determine who now owns the <br /> property. Posting and advertisement notices will need to be issued in this <br /> situation. <br /> Dawn Bittner explained that an inspection was conducted by Scott <br /> Sadusky, a licensed building inspector, and several violations were noted <br /> on his report. <br /> MAYOR ADAMS MOVED TO ADOPT RESOLUTION 17-19 DECLARING <br /> HAZARDOUS BUILDING AND ORDER FOR REMOVAL AT 30892 <br /> SOUTH HEATH STREET. COUNCIL MEMBER AKERSON SECONDED <br /> THE MOTION. MOTION CARRIED 3-0 <br />
