Nuisance Conditions Update for 31116 Ash Street <br /> City Attorney Scott gave an update on the John and Barbara Derksen <br /> property nuisance. City Attorney Scott explained that last minute <br /> negotiations at the May 2nd Special City Council Meeting between the City <br /> and Mr. Derksen's attorney resulted in the two parties not being in <br /> complete agreement as to the terms of the agreement, specifically <br /> whether the City retained its authority to assess the costs it incurs in <br /> completing the corrective actions against the property in the event the <br /> property owners fail to do so. City Attorney Scott explained to remedy this <br /> situation, the Council should rescind its vote to approve this contract which <br /> means that no pending enforcement action against Mr. Derksen will exist <br /> and if violation items remain outstanding the process will start over. <br /> COUNCIL MEMBER SWANSON MOVED TO RESCIND THE <br /> APPROVAL OF THE CONTRACT ON THE JOHN AND BARBARA <br /> DERKSEN PROPERTY. MAYOR ADAMS SECONDED THE MOTION. <br /> MOTION CARRIED 3-0. <br /> City Attorney Scott will inform Mr. Derksen's attorney that there is no <br /> longer an agreement and reiterate that his client knows what he needs to <br /> do to comply. <br /> 5. Adiournment <br /> There being no further business, COUNCIL MEMBER AKERSON <br /> MOVED TO ADJOURN. COUNCIL MEMBER SWANSON SECONDED <br /> THE MOTION.
