Derksen VIA PERSONAL SERVICE <br /> 31116 Ash Street <br /> Pequot Lakes, MN 56472 <br /> Re: NOTICE—IMMEDIATE CORRECTIVE ACTION REQUIRED <br /> City Ordinance Violations at 31116 Ash Street,Pequot Lakes,MN 56472 <br /> Dear Mr.and Mrs. Derksen: <br /> I am writing in my capacity as City Attorney for the City of Pequot Lakes (the"City"). The <br /> City's administrative staff has informed me that you have knowingly maintained conditions on <br /> your above-referenced property located at 31116 Ash Street(the"Property")that violate the <br /> City's Code of Ordinances(the"City Code")and which constitute a public nuisance. <br /> Specifically,City staff inform me that you have allowed garbage,junk, construction materials, <br /> brush/branches, furniture and other debris to accumulate in plain sight on the Property and <br /> maintained a recreational vehicle within ten feet of your lot line in violation of the City's Code <br /> of Ordinances and nuisance regulations (the"City Code"). Further, staff informs me that you <br /> have failed to remedy such conditions despite receiving numerous written and verbal notices of <br /> violation from the City, including the letters to you from the City's Zoning Administrator on <br /> June 5,2014 and July 3, 2014. <br /> This letter is intended to provide you notice of the City Code violations and nuisance conditions <br /> that continue on your Property and the corrective action that is necessary for you to avoid <br /> additional legal action against you. <br /> Violations of City Code and Nuisance Conditions <br /> The accumulation of garbage,junk, construction materials, brush/branches, furniture and other <br /> debris and recreational vehicle (in its current location)on the Property is in violation of the <br /> following City Code provisions: <br /> • Section 17-7.4 requires "(a)11 structures shall be properly maintained in a clean and <br /> acceptable manner so as not to constitute a menace to the public health, safety, <br /> convenience, general welfare, property values, and aesthetics". . . . and that"(a)11 <br /> landscaping shall be properly maintained so as to preserve planting in a live state and free <br /> of noxious weeds." <br /> • Section 17-7.5(B) requires that"all materials and equipment shall be stored within a <br /> building or fully screened so as not to be visible from adjoining properties." <br />
