In addition,the conditions on your property described above constitute a public nuisance under the following provisions in Chapter 7.2 of the City Code,which provides that anyone who maintains such conditions is guilty of a misdemeanor: • any condition"which unreasonably annoys, injures,or endangers the safety, health, morals, comfort,or repose of any considerable number of members of the public"(City Code§ 7-2.1); • accumulations of manure, refuse,or other debris(City Code § 7-2.2); • accumulations in the open of discarded or disused machinery,household appliances, automobile bodies, or other material, in a manner conductive to the harboring of rats, mice,snakes,or vermin, or the rank growth of vegetation among the items so accumulated, or in a manner creating fire,health,or safety hazards from such accumulation(City Code § 7-2.4); • alI other conditions or things which are likely to cause injury to the person or property of anyone(City Code § 7-2.4). Enforcement/Penalty Please be advised that pursuant to City Code Section 17-12.1, violation of any provision of Chapter 17 of City Code shall be considered either an administrative offense subject to an administrative fine; a criminal offense; or a civil offense subject to enforcement through civil remedies, including the abatement procedure described above. Each act of violation in every calendar day upon which said violation occurs or continues may be considered a separate offense. Further, a person who violates this Code is guilty of a misdemeanor and upon conviction thereof may be punished by a fine of not more than$1000.00 and/or imprisonment for a term not to exceed 90 days, or both.
