MEMBER SWANSON SECONDED THE MOTION. MOTION CARRIED 4- 0. 6.2.C. Ordinance Amendment Regarding Wetland Setbacks in all Zoning Classifications Dawn Bittner explained that the City Code contains minimum wetland setback requirements in zoning classifications from 50 feet to 75 feet depending on the classification. The Wetland Conservation Act does not contain a structure setback for wetlands. The Planning Commission unanimously recommends this Ordinance be amended requiring 30 feet of wetland setbacks in all zoning classifications based on two findings of fact. COUNCIL MEMBER LOUKOTA MOVED TO ADOPT ORDINANCE 17-02 TO AMEND CHAPTER 17 OF THE CITY CODE REGARDING WETLAND SETBACKS IN ALL ZONING CLASSIFICATIONS. COUNCIL MEMBER PEDERSON SECONDED THE MOTION. MOTION CARRIED 4-0. COUNCIL MEMBER SWANSON MOVED TO AUTHORIZE THE SUMMARY PUBLICATION OF ORDINANCE 17-02. COUNCIL MEMBER LOUKOTA SECONDED THE MOTION. MOTION CARRIED 4-0. 6.3. State Building Code Mayor Adams noted that Pat Tweed has submitted a letter to the Council supporting the adoption of a City wide building code. Tom Nelson addressed the Council regarding the Fire Department's support of a building code for Pequot Lakes. He noted that there is currently no checks and balance in place for contractors and the Fire Department has been in situations where buildings have been unsafe for training bums. Dawn Bittner noted the cities of Baxter, Brainerd, Breezy Point, and Pine River currently enforce the state building code. COUNCIL MEMBER PEDERSON MOVED TO DIRECT THE PLANNING COMMISSION TO REVISIT THE ADOPTION OF THE STATE BUILDING CODE AND BRING FORTH A RECOMMENDATION TO THE CITY COUNCIL. COUNCIL MEMBER SWANSON SECONDED THE MOTION. MOTION CARRIED 4-0. 9.2.
