Ordinance Amendment Regarding Wetland Setbacks in all Zoning <br /> Classifications <br /> Dawn Bittner explained that the City Code contains minimum wetland <br /> setback requirements in zoning classifications from 50 feet to 75 feet <br /> depending on the classification. The Wetland Conservation Act does not <br /> contain a structure setback for wetlands. The Planning Commission <br /> unanimously recommends this Ordinance be amended requiring 30 feet of <br /> wetland setbacks in all zoning classifications based on two findings of fact. <br /> COUNCIL MEMBER LOUKOTA MOVED TO ADOPT ORDINANCE 17-02 <br /> TO AMEND CHAPTER 17 OF THE CITY CODE REGARDING WETLAND <br /> SETBACKS IN ALL ZONING CLASSIFICATIONS. COUNCIL MEMBER <br /> PEDERSON SECONDED THE MOTION. MOTION CARRIED 4-0. <br /> COUNCIL MEMBER SWANSON MOVED TO AUTHORIZE THE <br /> SUMMARY PUBLICATION OF ORDINANCE 17-02. COUNCIL MEMBER <br /> LOUKOTA SECONDED THE MOTION. MOTION CARRIED 4-0. <br /> 6.3. State Building Code <br /> Mayor Adams noted that Pat Tweed has submitted a letter to the Council <br /> supporting the adoption of a City wide building code. <br /> Tom Nelson addressed the Council regarding the Fire Department's support <br /> of a building code for Pequot Lakes. He noted that there is currently no <br /> checks and balance in place for contractors and the Fire Department has <br /> been in situations where buildings have been unsafe for training bums. <br /> Dawn Bittner noted the cities of Baxter, Brainerd, Breezy Point, and Pine <br /> River currently enforce the state building code. <br /> COUNCIL MEMBER PEDERSON MOVED TO DIRECT THE PLANNING <br /> COMMISSION TO REVISIT THE ADOPTION OF THE STATE BUILDING <br /> CODE AND BRING FORTH A RECOMMENDATION TO THE CITY <br /> COUNCIL.
