SECTION 3. ESTABLISHMENT OF A CITY TREE BOARD. There is hereby
<br /> created and established a City Tree Board for the City of Pequot Lakes ,
<br /> Minnesota, which shall consist of not less than five (5 ) nor more than
<br /> seven ( 7 ) members , who shall be appointed by the Mayor with the
<br /> approval of the City Council . The City Clerk or his/her representative
<br /> and the Public Works Director shall be ex officio members of this
<br /> board .
<br /> A. Term of Office. Each member shall serve a term of three
<br /> years . The first appointments to the Tree Board shall designate two
<br /> members whose terms shall expire June 1 , 1996 three members whose terms
<br /> shall expire June 1 , 1997 , and two members whose terms shall expire
<br /> June 1 , 1998 . In the event that a vacancy shall occur during the term
<br /> of any member , a successor shall be appointed as herein provided for
<br /> the remaining portion of the term.
<br /> B. Compensation. Members of the Tree Board shall serve without
<br /> compensation .
<br /> C. Duties and Responsibilities. The tree board shall be
<br /> responsible for developing policies regarding the care , preservations ,
<br /> planting , replanting , removal , or disposition of trees and shrubs in
<br /> parks , in the public right of way, along trails , and in other public
<br /> areas , and for developing an annual tree planting and maintenance plan .
<br /> The plan shall be presented to the City Council for review an approval .
<br /> All action taken by the Board shall be within the budget constraints of
<br /> the City. The Board may , subject to City Council approval organize
<br /> volunteer community efforts to raise funds for tree planting on
<br /> — boulevards or for other activities , and may, subject to City Council
<br /> approval , set fees to carry out the requirements of this ordinance .
<br /> The Board , when requested by the City Council , shall consider,
<br /> investigate , make findings, report and recommend upon any special
<br /> matter of question coming within the scope of its work . The Tree Board
<br /> shall report its activities to the City Council quarterly each year .
<br /> D. Operation. The Board shall choose its own officers , make its
<br /> own rules and regulations and keep a journal of its proceedings . A
<br /> majority of the members shall constitute a quorum for the transaction
<br /> of any business .
<br /> E. Interference with City Tree Board. It shall be unlawful for
<br /> any person to prevent , delay or interfere with the Tree Board , or any
<br /> of its agents , while engaging in and about the planting , cultivating ,
<br /> mulching , pruning, spraying , or removing of any public trees or trees
<br /> on private grounds , as authorized in this ordinance .
<br /> F. Review by City Council . Any person aggrieved by any ruling
<br /> or order of the City Tree Board may appeal to the City Council , which
<br /> shall hear the matter and make a final decision . The City Council
<br /> shall have the right to review the conduct and decisions of the City
<br /> Tree Board . The City Council may modify, affirm or reverse any
<br /> determination of the City Tree Board .
<br /> SECTION 4. PUBLIC TREE CARE IN GENERAL.
<br /> A. Care of Trees in Public Areas. The Tree Board , or its agent ,
<br /> shall have the right to plant , prune, maintain, and remove trees,
<br /> plants, and shrubs in parks , in the public right of way, along trails ,
