• <br /> ORDINANCE NO. 161 <br /> _ AN ORDINANCE REGULATING THE PLANTING AND MAINTENANCE OF TREES <br /> AND OTHER WOODY VEGETATION WITHIN THE CITY OF PEQUOT LAKES <br /> AND ESTABLISHING A CITY TREE BOARD <br /> SECTION 1 . POLICY AND PURPOSE. The purpose of this ordinance is <br /> to establish polices to protect and enhance the City of Pequot Lakes <br /> urban forest , to the extent found by the City Council to be practical <br /> within available financial and staff resources . The City Council has <br /> determined that the health of the shade trees within the municipal <br /> limits are threatened by shade tree diseases . It has further <br /> determined that the loss of shade trees, growing upon public and <br /> private property, would substantially depreciate the value of property <br /> and impair the safety , good order, general welfare , and convenience of <br /> the public . It has further determined that conditions of trees may <br /> exist that could create risks of injury to persons or damage to <br /> property or a hazard to public traffic safety. It is declared to be <br /> the intention of the council to control and prevent the spread of <br /> diseases , and provide for the removal of dead , diseased trees or <br /> nuisances as described . <br /> SECTION 2. DEFINITIONS. The language set forth in this ordinance <br /> shall be interpreted in accordance with the following definitions . <br /> A. "Boulevard" means the area between the edge of the street or <br /> — the back of the curb , where curb and gutter exist , and the property <br /> line . <br /> B . "Conifer insect and diseases" means infestations of insects <br /> and diseases that are injurious to the life of conifer trees . <br /> C. "Disease control area" means the entire city except those <br /> areas annually designated by the tree board as "no control zones" <br /> pursuant to state law. <br /> D . "Public trees" means any tree or shrub located in any park , <br /> public right of way , trail , or other public space . <br /> E. "Public space" includes but is not limited to the grounds of <br /> public buildings, designated open space , city owned property, street , <br /> alley, and trail rights of way . <br /> F . "Shade trees" means oak , maple , elm and all other deciduous <br /> trees in the city. <br /> G. "Tree Board" means the committee appointed by the Mayor . <br /> H. "Tree control program" means a program developed by the Tree <br /> Board to combat tree diseases . <br /> I . "Tree disease" means Dutch Elm Disease, Oak Wilt or any other <br /> tree diseases. <br /> J . "Tree Inspector" means a city employee or qualified person <br /> appointed by the Council , together with his/her designated assistants. <br />
