and in other public areas , as may be necessary or desirable to protect <br /> public safety or to preserve or enhance the symmetry and beauty of such <br /> _ public grounds. <br /> B. Removal of Unsafe Trees. The Tree Board may remove or cause <br /> or order to be removed any trees or part thereof which is in an unsafe <br /> condition or which by reason of its nature or location is injurious to <br /> sewers , electric power lines , gas lines , water lines or other public <br /> improvements , or is affected with any injurious disease, insect , or <br /> other pest . <br /> C. Planting Boulevard Trees. No tree may be planted on the <br /> boulevard except by permit obtained from the Tree Board . The Tree <br /> Board may remove or cause or order to be moved or removed any boulevard <br /> tree not planted by permit , or any boulevard tree which is not in <br /> compliance with this ordinance . This section does not prohibit the <br /> planting of boulevard trees by adjacent property owners providing the <br /> selection, locations , and care of said trees are in accordance with the <br /> provisions of this ordinance. <br /> D. Tree Trimming. The Tree Board , or its agent , shall have the <br /> authority to trim trees in parks and other public spaces . The Tree <br /> Board , or its agent , shall have the authority to trim boulevard trees, <br /> as needed , to allow the movement of the city street maintenance <br /> equipment along the streets . The property owner shall be responsible <br /> for aesthetic trimming ; for trimming on any corner lot which is <br /> necessary to allow visibility at intersections ; for trimming of any <br /> boulevard tree or shrub which is necessary to maintain adequate <br /> sightlines for vehicles , bicycles , and pedestrians; and for any other <br /> trimming not specifically assigned to the Tree Board , or its agent . <br /> E. Pruning and Removal of Dead Branches and Trees. Every owner <br /> of any tree within the city shall prune the branches so as to remove <br /> all dead, diseased , dangerous, or broken or decayed limbs . Any <br /> standing dead or fallen tree is hereby declared a public nuisance . Any <br /> such tree shall be removed and disposed of promptly by the owner , or in <br /> the case of boulevard trees by the Director of Public Works . Standing <br /> or fallen dead trees located in public owned parks or open spaces shall <br /> be removed at the discretion of the Director of Public Works. <br /> F. Storm Damage. The Director of Public Works shall be <br /> responsible for cleanup of downed trees, broken limbs and stump removal <br /> of storm damaged boulevard trees . <br /> G. Stump Removal . All boulevard stumps shall be removed four <br /> inches below the surface of the ground so that the top of the stump <br /> shall not project above the surface of the ground . <br /> H. Abuse or Mutilation of Trees. No person shall intentionally <br /> damage, cut , carve , transplant , or remove any public tree ; attach any <br /> rope , wire, nails , advertising posters , or other contrivances to any <br /> public trees ; allow any gaseous , liquid , or solid substance which is <br /> harmful to such trees to come into contact with them; or set any fire <br /> __ Jr permit any fire to burn when such fire or the heat thereof will <br /> injure any portion of the tree ; or to direct or authorize such activity <br /> or circumstance . <br />
