Section 26. Issuance--generally. <br /> (a) The City Clerk shall not issue any annual license under this Ordinance unless <br /> directed to do so by resolution duly adopted by the City Council. Any resolution granting <br /> a license may be conditioned on final departmental or commission approvals,payment of <br /> taxes or any other condition the council deems appropriate. The City Clerk shall not issue <br /> any license until all such conditions are met. <br /> (b) The City shall cause an investigation to be made of all of the representations set <br /> forth in the applications. Opportunity shall be given at a regular or special meeting of the <br /> city council or planning and zoning commission to any person to be heard for or against <br /> the granting of any license. After such investigation, the City Council shall grant or <br /> refuse such license in its discretion; provided that no off sale intoxicating or on sale wine <br /> liquor license shall become effective until it, together with any required insurance policy, <br /> has the approval of the state Liquor Control Commissioner. <br /> (c) The licensed premises shall have the current license posted in a conspicuous <br /> place. <br /> Section 27. Corporations. <br /> (a) Alcoholic beverage licenses may be issued to any corporation authorized to do <br /> business in the state of Minnesota if an officer or a managing agent of the corporation is a <br /> resident of Minnesota residing within 20 miles of the city. <br /> (b) No corporation shall be granted a license to sell alcoholic beverages if any of its <br /> officers, directors, shareholders, local managers or local managing agents have been <br /> convicted within five years prior to the application for such license for violation of any <br /> law relating to the manufacture, sale, distribution or possession of alcoholic beverages, or <br /> have had an interest in a license to sell alcoholic beverages which was revoked within the <br /> last five years for violation of any such law. <br /> (c) A corporation shall state in its application for an alcoholic beverage license the <br /> names of its shareholders, directors, officers, local managers and local managing agents. <br /> The transfer, sale,pledge, or assignment of the record or equitable ownership of any <br /> stock of a corporate license holder to new or different shareholders, or the election or <br /> appointment of any new or different directors or officers, shall be deemed a transfer of all <br /> alcoholic beverage licenses held by such corporation. The failure of any corporate license <br /> holder to comply with the provisions of this paragraph shall be grounds for the revocation <br /> of all alcoholic beverage licenses held by such corporation. <br /> Section 28. Transfer; modification of licensed premises. <br /> (a) No license issued under the provisions of this Ordinance shall be assigned or <br /> transferred by the licensee, nor shall a change of address in the location of the licensed <br /> Page 12 <br />
