temporary basis for a special event, and shall be subject to any conditions and limitations <br /> the City Council deems appropriate. <br /> (b) Licensees holding off sale and on sale licenses on the same location or premises <br /> must display and sell all off sale merchandise in an area that is clearly separated from the <br /> on sale part of the premises (by solid wall or partition) with separate entrance and exit. <br /> Section 23. Duration; expiration date; prorating of certain licenses. <br /> (a) All licenses shall be for one year and shall commence on July 1 and expire on <br /> June 30. <br /> (b) All applications, including renewals for annual licenses shall be submitted, along <br /> with payment of annual fee, to the City Clerk no later than May 15. <br /> (c) The City Council may, as it determines under appropriate circumstances,prorate <br /> annual fees for a partial year. <br /> Section 24. Fees. <br /> (a) Fixing Fees: Except as otherwise specifically provided, all fees for licenses <br /> provided for in this Chapter, including but not limited to, license fees, <br /> investigation and administration fees, shall be fixed and determined by the <br /> Council, adopted by resolution, and uniformly enforced. Such fees may, from <br /> time to time, be amended by resolution of the Council. <br /> (b) Fee Increases: Notwithstanding other provisions of this Chapter, no license fee <br /> shall be increased except after notice and hearing on the proposed increase. <br /> Notice of the proposed increase shall be mailed to all affected licensees at least <br /> thirty(30) days before the date set for hearing. <br /> (c) In any case where any payment for any alcoholic beverage license is not made <br /> when due, a ten(10)percent penalty shall be added to the fee. <br /> (d) Nonpayment of fees shall constitute good cause for suspension or revocation of <br /> any license. <br /> Section 25. Refund of fees in certain cases. <br /> If, during the term of an annual liquor license, the place of business of any <br /> licensee shall be destroyed or so damaged by fire or otherwise that the licensee shall <br /> cease to carry on the licensed business or, if the business of the licensee shall cease by <br /> reason of illness or death or if it shall become unlawful for the licensee to carry on the <br /> licensed business under her/his license, through no fault of the licensee, the City Council <br /> may refund to the licensee, or to the estate, such part of the license fee paid as <br /> corresponds to the time such license had yet to run. <br /> Page 11 <br />
