f.
use whatever force is reasonably necessary to apprehend
said dangerous felons while attempting to minimize the
risk of harm to the public and the police officer.
D. General Policies of Hot Pursuit. "Hot Pursuit" as
used herein means the operation of a squad car in a manner
intended to overtake and apprehend a violator when there
is an indication the violator may be attempting to elude
the pursuing squad car. It does NOT include operation of
a squad car when such squad car is being positioned to
observe traffic, on stake-out, nor does it apply to
routine traffic stops when there is no indication of an
attempt to elude.
(1) In any hot pursuit, the police officer shall activate
red lights and siren; shall notify dispatch of the
hot pursuit and request 10-33 status; and both the
police officer and the dispatcher should request
assistance from other area law enforcement units in
reasonable position to assist.
(2) An officer shall terminate pursuit when continuation
thereof could reasonably be expected to result in
undue danger to the general public, the person being
pursued, or the police officer.
(3) After any situation involving a pursuit wherein the
violator obviously attempted to evade apprehension,
the police officer shall promptly prepare a written
report to the Police Chief on an investigation
report form.
E. Operation of Squad Cars as Authorized Emergency Vehicle.
Use of the squad car as an authorized emergency vehicle
is granted to the police office when proceeding to an
emergency call such as motor vehicle collisions, crimes
in progress, officer in trouble, and other emergencies
requiring an immediate response. Every police officer
shall proceed expeditiously. Because of the many
variables involved, the speed at which the police officer
operates the squad car must be with full consideration of
weather and road conditions, traffic and pedestrian
movement, and the relative need for immediate action. It
is incumbant upon the police officer to comply with the
sections of the law governing the operation of an
emergency vehicle.
(1) 169.03, Subd. 2: "The driver of any authorized
emergency vehicle, when responding to an emergency
call, upon approaching a red or stop signal of any
stop sign, shall slow down as necessary for safety,
but may proceed cautiously past such red or stop
8
t
