(h) Improper or unjustified restraint of a person's liberty. <br /> (i) Harassment or method of police action predicated upon <br /> factors irrelevant, such as race, attire, sex, age, <br /> religion, or personal benefit of police officer. <br /> (j) Willful or negligent violation of the Data Practices Act. <br /> (k) Failure to report data, conduct, or actions which may <br /> result in potential claims against the City or police <br /> personnel in a timely fashion. <br /> (17) Pursuit Driving and Emergency Vehicle Operation. <br /> A. Pursuit and Emergency Vehicle Operation Policy. The <br /> policy of the City of Pequot Lakes Police Department shall <br /> be to vigorously pursue and apprehend all violators or <br /> suspected violators of the law with due regard for the <br /> safety of the motoring public, bystanders, the violator or <br /> suspected violator being pursued, and the peace officer. <br /> These same requisites govern the police officers when <br /> responding to the scene of any motor vehicle collision or <br /> other emergency situation. <br /> B. Pursuit of Traffic Violators, Misdemanants, Gross <br /> Misdemeanants and Nondangerous Felons. Every police <br /> officer, when in hot pursuit of an actual or suspected <br /> violator shall activate the siren and red lights of the <br /> squad car to give warning to other motorists and <br /> bystanders. When in hot pursuit of an actual or suspected <br /> violator, the operation of the squad car shall be with <br /> full consideration of existing conditions. Primary <br /> consideration must be given to the determination of <br /> whether or not to continue hot pursuit, especially if the <br /> opportunity to apprehend the violator at a later time <br /> exists. This involves the officer's ability to identify <br /> or otherwise establish the identity of the person <br /> involved. Other circumstances that must be taken into <br /> consideration are weather and road type and conditions, <br /> the prevailance of vehicle and pedestrian traffic, the <br /> seriousness of continued operation by the violator, and <br /> the seriousness of the original offense or offenses <br /> committed. In any pursuit involving the types of viola- <br /> tions above, the police officer shall NOT use his <br /> squad car to ram or force the pursued vehicle off the <br /> roadway, except when the person being pursued is grossly <br /> endangering the lives of others and NO OTHER means of <br /> stepping the suspect vehicle is readily available. <br /> C. Pursuit of Dangerous Felons. Every police officer, <br /> when in pursuit of dangerous felons, shall expeditiously <br /> 7 <br />
