. _. J <br /> County Sheriff or other independent investigative authority <br /> for investigation. Any allegations against the Police Chief <br /> or potential criminal violations of state statutes shall be <br /> referred to the City Attorney for determination of whether <br /> to refer said matter to the Personnel Commission, the County <br /> Sheriff or a special independent investigative authority. <br /> (14) P.O.S.T. Board. The Chief of Police shall be responsible <br /> for monitoring and implementing and reporting to the City <br /> Council all P.O.S.T. Board regulations or changes. The Chief <br /> shall report at least bi-annually to the City Council any <br /> changes or modifications or requirements of the P.O.S.T. <br /> Board. The Chief shall be responsible for verifying that <br /> all police personnel are duly licensed with the P.O.S.T. <br /> Board and that their license status with the P.O.S.T. Board <br /> is maintained throughout their employment with the City of <br /> Pequot Lakes. <br /> (15) Outside Emergencies. The Chief is authorized pursuant to <br /> Minnesota Statutes Section 12.27, to exercise discretion and, <br /> considering the needs of the city subdivision and its <br /> inhabitants, to dispatch equipment and personnel as deemed <br /> necessary if there is a danger of fire, hazard, casualty, or <br /> another similar occurrence outside the City and by its <br /> suddenness it would be impractical for the governing body <br /> itself to authorize the dispatch of equipment and personnel <br /> to combat the occurrence. However, the Chief shall follow <br /> the lines of command articulated above prior to exercising <br /> his discretion. <br /> (16) Discharge of Police Department Employee. A Police Depart- <br /> ment employee, including the Police Chief, shall be discharged <br /> for the following acts of misconduct: <br /> (a) A gross misdemeanor or felony conviction or plea bargain <br /> regarding the same while employed by the City of Pequot Lakes. <br /> (b) Use or under the influence of intoxicants or illicit <br /> drugs while on duty or while performing official police <br /> functions for the City. <br /> (c) Bribery, receiving funds or property for personal use <br /> or converting public property for personal use. <br /> (d) Willful disobedience of a direct Council order. <br /> (e) Substantiated sexual harassment. <br /> (f) Unwarranted threats and use of excessive force against <br /> any"person. <br /> �-- (g) Improper or unjustified arrest. <br /> 6 <br />
