Motion carried. <br /> APPLICANT: Kenneth and Elizabeth Hirschey. <br /> Applicant requests a Variance to install a drain field for an Individual Sewer <br /> Treatment System (ISTS)within the side yard setback and Middle Cullen Lake <br /> OHW setback. <br /> Applicant was present: Ellen Hirschey, daughter, 5655 Walleye Bay, Pequot <br /> Lakes. <br /> Mr. Marohn explained his Staff Report. He pointed out that if the drain field is <br /> centered along the east property line, it would not be within the 75' OHW <br /> setback. <br /> Mr. Nelson stated that the well could be moved and the drain field would not <br /> have to be within the setback. Ms. Hirschey stated that the well is approximately <br /> 25' from the lake and trees would have to be removed without a variance. A <br /> variance would maximize the distance from the well. The existing cabin is <br /> approximately 30' from the OHW. <br /> There was discussion whether or not to table until more accurate drawings could <br /> be submitted. Applicant advised that the property line has been surveyed. An <br /> alternate site for a drain field was not included on the design. Due to the size of <br /> the lot and parking issues, there is no room for an alternate site. It was <br /> determined that the pressure bed was designed large enough for a 3-bedroom <br /> home. <br /> A motion was made by Mark Hallan, seconded by Joe Dotty, to recommend <br /> approval of the variance subject to the following conditions: <br /> 1. The applicants shall place the drain field as close to the center of the <br /> eastern property line (centering it at approximately 95.5'from north to <br /> south) as possible so as to reduce or eliminate any encroachment into the <br /> lake OHW setback to the north or south. Placement directly along the <br /> center of the lot line would meet all lake OHW setbacks. <br /> 2. The design does not show an alternate site for the drain field. If this ISTS <br /> fails, applicant will be required to install an alternate system off-site or <br /> install a holding tank. <br /> All members voted "aye".
