3. Adult Theater— an enclosed building with a capacity of 50 or more persons used <br /> regularly and routinely for presenting live entertainment or motion pictures, <br /> including but not limited to film and video tape, having as a dominant theme <br /> material distinguished or characterized by an emphasis on matter depicting, <br /> describing, or relating to "Specified Sexual Activities" or"Specified Anatomical <br /> Areas" for observation by patrons therein. <br /> 4. Adult Mini-Theater—an enclosed building with a capacity for less than 50 persons <br /> used for presenting motion pictures, including but not limited to film and video <br /> tape, including but not limited to private booths, viewing by means of coin <br /> operated or other mechanical devices, and the viewing of excerpts of motion <br /> pictures offered for sale or rent, having as a dominant theme material distinguished <br /> or characterized by an emphasis on matter depicting, describing or relating to <br /> "Specified Sexual Activities" or"Specified Anatomical Areas" for observation by <br /> patrons therein. <br /> 5. Specified Sexual Activities—any of the following conditions: <br /> a. Human genitals in a state of sexual stimulation or arousal. <br /> b. Acts or explicit representations of acts or human masturbation, sexual <br /> intercourse or sodomy, bestiality, oral copulation or flagellation. <br /> c. Fondling or erotic touching of human genitals, pubic region, buttock or female <br /> breast. <br /> d. Excretory functions as part of or in connection with any activities set forth in a <br /> through c above. <br /> 6. Specified Anatomical Areas—any of the following conditions: <br /> a. Less than completely and opaquely covered: human genitals, pubic region or <br /> pubic hair, buttock, female breast below a point immediately above the top of <br /> the areola, and <br /> b. Human male genitals in a discernibly turgid state, even if opaquely covered. <br /> B. General Provisions <br /> 1. Adult Use businesses are only allowed in the Commercial (C-1) District, subject to <br /> the requirements listed in this section and all other requirements of the Sibley <br /> Zoning Ordinance being met. <br /> 2. No adult use business shall be located within a one-thousand (1000) foot radius of <br /> any place of worship, park, school, or residentially zoned district as measured in a <br /> straight line, without regard to intervening structures, from the property line of the <br /> school, park, place of worship or residential zoning district to the property line of <br /> the adult use business. <br /> 3. No adult use business shall be permitted to locate within one hundred fifty (150) <br /> feet of any Highway 371 Corridor (HI) District property. <br /> Sibley Township Zoning Ordinance Article II 57 <br />
