A motion was made by Karl Moon, seconded by Bill Habein, to approve the Conditional <br /> Use Permit, subject to the remaining conditions: <br /> 1. The applicant shall submit revised association documents addressing the long- <br /> term preservation and maintenance of open space consistent with the City's <br /> Ordinance. The revised document must be acceptable to a majority of the <br /> Planning Commission. <br /> 2. Association documents must be reviewed and be acceptable to the City <br /> Attorney. <br /> 3. Each individual unit shall have, and shall be considered, a separate water and <br /> sewer connection. Each individual unit shall have a separate water meter. <br /> All members voted"aye". Motion carried. <br /> APPLICANT: Carl and Colleen Smith. <br /> Applicant requests approval of a Preliminary Plat of Trail View Townhouses <br /> (continuation). <br /> Mr. Marohn explained his Staff Report. <br /> A motion was made by Karl Moon, seconded by John Derksen, to approve the <br /> Preliminary Plat, subject to the following conditions: <br /> 1. Applicant shall provide all of the required concurrent documents prior to final <br /> plat approval by the Planning Commission. <br /> 2. The applicant shall complete the final platting process within 12 months or the <br /> preliminary plat approval will be voided. <br /> All members voted"aye". Motion carried. <br /> Mr. Smith requested obtaining a building permit to start construction. Mr. Marohn <br /> informed him that only one permit could be issued. Mr. Smith reminded Mr. Marohn that <br /> there were three parcels. Mr. Marohn agreed that one permit per parcel could be issued. <br /> Mr. Marohn would be in the office the following Thursday. <br /> APPLICANT: NWT LP <br /> Applicant requests Preliminary Plat approval of The Ridge (continuation). <br /> Mr. Marohn explained to the Commission that the City Attorney, Tom Fitzpatrick, had <br /> contacted the Attorney General and the League of Minnesota Cities regarding the zoning <br /> on this piece of property. It is their interpretation that this property is not currently zoned <br /> as the correct procedure had not been done. A Public Hearing would have to be held to <br /> zone this property. Mr. Marohn recommended that this matter be tabled pending the <br /> hearing on the zoning next month and make a recommendation to the City Council. <br />
