After discussion a Motion was made by Karl Moon to grant the Conditional Use Permit for a <br /> Planned Unit Development with the following conditions: <br /> 1. There shall be on additional topographic alterations to the property once the <br /> construction of the approved development has been completed. <br /> 2. Existing trees on the south side of the property shall be maintained <br /> 3. Landscaping improvements shall be completed as shown on the site plan <br /> 4. Stormwater runoff from the dwelling shall be collected on site. Floor drains and roof <br /> drains shall not discharge to the municipal sanitary sewer system. <br /> 5. There shall be no exterior storage on the site except that confined to the patio areas. <br /> 6. Each unit shall be allowed a maximum of one vehicle parked on the property. The <br /> vehicle shall not be parked in the driveway for more than 8 hours during any 24 hour <br /> period. <br /> 7. The HRA may not sell the property without a resolution from the City Council allowing <br /> the sale. <br /> 8. The applicant must use best management practices during construction to prevent <br /> runoff and protect the City's sewer system from discharge of sediments and nutrients. <br /> Cheri Seils seconded the motion. <br /> Cheri Seils and Mark Hallen abstained from voting. <br /> All other members of the Commission voted aye. <br /> APPLICANT:Joni Tulenchik <br /> Represented by Kevin Mc Cormick of Landecker and Associates. <br /> Applicant wants to rezone 91.04 acres from Public/Open to Commercial and Wooden Residential <br /> Mr.McCormick feels that this development proposed for this parcel of land would be appealing, <br /> unique and needed homesites for the community. They would be large lots 2%:to 4'A acres each, <br /> Best ways to utilize the land. These would be high-end homes with a conservation easement,there <br /> would be s50 ft setbacks to the back and 25 setbacks to each side. He stated he would like to proceed <br /> this evening to re-zone into a residential area. There would be covenants and deed restrictions. The <br /> developer would incur the cost of road construction and paving in the development. <br /> Part of the land is still in Sibley Township,he felt that zoning portion of this east of the Paul Bunyan <br /> Trail would be consistent with the Commercial along the 371 corridor. <br /> Mr.Slayton stated that we received the information from Landecker's at 4:05 the previous day and <br /> did not have adequate time to research the project. <br /> Craig Nagel stated that we are planning backage roads for the future and these are to be put into <br /> plans. We already have three housing areas in the City,Evergreen Development to the South,Field <br /> of Dreams and several platted lots in Pequot Shady Shores. The lots in Pequot Shady Shores are <br /> close to the newly constructed water tower and would be the easiest for the City to extend services. <br /> Bill Habein felt that if we re-zone we would lose control of the area and stated that the client has <br /> already cleared around wetlands on the property. <br /> The suggestion was to have the applicant submit a preliminary plat and have the issue of re-zoning <br /> put on the agenda for the June meeting. <br /> Karl Moon made a motion to table the application until next month. <br /> Cheri Seils seconded the motion,all ayes,motion carried. <br /> Sharon Thurlow stated that she has a copy of a recent housing study as it stands today and would <br /> give a copy to the Commission. <br />
