Karl Moon made a motion to table the application for 2 to 3 months to allow time for the <br /> Commission to move forward in the planning process. Cheri Seils seconded the motion. <br /> All ayes with the exception of Mr Dotty who voted no. <br /> APPLICANT: Robert Lee Fisher <br /> 3858 Coleman Drive <br /> Pequot Lakes,Minnesota <br /> Mr.Fisher's application is a continuation of the April meeting. He is requesting a variance to the <br /> Shoreline Setback. <br /> Mr.Fischer stated that he felt it was a hardship due to the fact of the pie shaped lot. He felt that <br /> relocating the building was not a reasonable solution and would be a geometric headache and he does <br /> not care to build it that way. <br /> The question was asked several times whether this would be an addition to present structure or new <br /> construction. This had to be established. <br /> The findings of fact support denying a variance: <br /> 1. There is no hardship due to the fact that there is adequate area to construct a home or <br /> addition in a conforming location. <br /> 2. The circumstances causing the alleged hardship are not caused by someone or <br /> something because the owner wishes to build a specific addition in this specific area. <br /> 3. This variance is not in harmony with the Sibley Land Use Plan and Ordinance <br /> The home or addition could be constructed in a conforming location. <br /> 4. The intent of the Ordinance and Comp Plan are to maintain minimum setbacks which <br /> Maintain the essential character of the locality. <br /> Bill Habein made a motion to deny the variance and resubmit under new construction. <br /> Karl Moon seconded the motion,all ayes,motion carried. <br /> APPLICANT:Robert Rickard <br /> 5804 25th Avenue S.W. <br /> Pequot Lakes,Minnesota 56472 <br /> Mr.Rickard's application is a continuation of the April meeting. He is requesting a Conditional Use <br /> Permit to operate a R.V. service and repair center. <br /> He submitted an updated lighting site plan to Mr.Slayton <br /> No response has been received from SWCD on this application. <br /> A letter from Ken Larson,MnDot was submitted(attached) <br /> Mr.Hardy felt there was a misconception of the business,that there was no need for MPCA and <br /> EPA permits for disposal of lubricants etc. This operation would come under exempt due to the fact <br /> of the amount of oil to be disposed of. Also the anti-freeze would be bio-degradeable. <br /> Mr. Swanson(Mr.Hardy's partner) <br /> 13498 <br /> Crosslake,Minnesota <br /> Mr.Swanson questioned the screening.Dennis replied to have a 50ft buffer facing 371, screening to <br /> residential to the rear,also the screening for repairs of down vehicles. <br />
