The Planning Commission would like to see the road profiles worked out. Mr. <br /> McCormack stated that they could address the road issues next month, earth movement to <br /> create the building pads, erosion and look at a PUD with Mr. Marohn. The Individual <br /> Sewage Treatment System is located within the easement on Lot 1, Block 1. The <br /> Planning Commission would like to see a concept of a building pad, along with parking. <br /> Areas need to be defined as buildable and non-buildable. A CUP may not be required <br /> under the new Ordinance. <br /> Mr. McCormack stated he is willing to accept a table. The Planning Commission would <br /> like to see written comments from MnDOT regarding access and possible median <br /> crossing. Mr. McCormack stated it may take some time to receive MnDOT's comments <br /> and would work with applicant on a 60 day waiver. Staff was directed to contact <br /> applicant to schedule a meeting. <br /> A motion was made by Karl Moon, seconded by Marty Nelson, to table this matter. All <br /> members voted"aye". Motion carried. <br /> APPLICANT: William Wortham, Kevin Hughes and Thomas Ressemann. <br /> Applicant requests Preliminary Plat of Sibley Acres. <br /> Kevin McCormach, Landecker and Assoc.,was in attendance representing applicants. <br /> Mr. Marohn explained the Staff Report, stating that the parcel is zoned Wooded <br /> Residential, a zone not included in the Zoning Ordinance. He further stated there are 8 <br /> questions on page 17 that must be addressed. The City had received a letter from Kirk <br /> Adams of the Sandelin Law Office, stating there would be legal action regarding a <br /> boundary dispute of the north boundary line. <br /> Public Comment: Brian Tweed, 31340 Brunes Street, Pequot Lakes, stated Landecker <br /> and Assoc. knew about this problem and dropped the issue. <br /> Mr. Marohn stated that the City cannot comment on a private property boundary dispute. <br /> Two of the proposed lots are within 1,000 feet of the lake. The pole barn is in the right of <br /> way of North Oak Street and the shed is in the setback. A condition could be added that <br /> if the City develops the road that the property owner would move the building at his cost. <br /> A motion was made (could not tell who made the motion), seconded by Mark Hallan, to <br /> table this matter. All members voted"aye". Motion carried. <br /> APPLICANT: Wilderness Resort Villas, LLC <br /> Applicant requests a Conditional Use Permit for Dwelling Units to be Moved. <br />
