MINUTES <br /> `-- PEQUOT LAKES PLANNING AND ZONING COMMISSION <br /> FEBRUARY 19, 2004 <br /> PRESENT: Tom Adams, Bill Habein, Marty Nelson, Karl Moon, Tom Woog, and <br /> Mark HaIlan. ABSENT: Joe Dotty and John Derksen. <br /> PLANNING ADMINISTRATOR: Charles Marohn, PE. <br /> ZONING ADMINISTRATOR: Dawn Bittner. <br /> The meeting was called to order at 6:33 by Tom Woog, Chairperson. <br /> APPLICANT: City of Pequot Lakes <br /> Applicant requests a rezoning of Sibley Center from Agriculture to Commercial <br /> and/or an Ordinance Amendment to allow professional offices and contractor's <br /> offices in the agricultural zone. <br /> Mr. Marohn explained his Staff Report. Any new use would need to remain <br /> compatible with the surrounding agricultural area. The use would need to be <br /> defined. Mr. Marohn suggested professional offices and contractor's offices. <br /> They could be a permitted use or a conditional use. A conditional use would add <br /> one more step to determine that the intended use would be compatible with the <br /> area. Conditions can be added to a Conditional Use Permit. If Sibley Center <br /> were rezoned to commercial, it would be a spot zone. If the Ordinance is <br /> amended, there could be major implications to the rest of Agricultural property <br /> within the City. <br /> Public Comment: Justin Bolz-Andolshek inquired whether a multi-tenant was <br /> allowable. It would be allowed, controlled with the Conditional Use Permit <br /> process. Ryan Buell commented that the use seemed to be a commercial use. <br /> Mr. Marohn explained that zoning Sibley Center commercial could create more <br /> problems, have negative repercussions and negative impacts. <br /> A motion was made by Karl Moon, seconded by Bill Habein, to recommend the <br /> amendment of Ordinance 35.030 to include business office as a conditional use. <br /> All members voted "aye". Motion carried. <br /> (The meeting was recessed at 7:18 to allow the City Council to act on the <br /> recommendation of the Planning Commission. The amendment required a <br /> 4/5ths vote of the Council. It was determined the Council was short one <br /> member. Councilman Bolz-Andolshek went to the school to inform Councilman <br /> Akerson that he needed to return from Parent's night for the vote.) <br />
