L <br /> STAFF REPORT <br /> Application: Final Plat of RV Resort at the Preserve <br /> Applicant: Dan Helbling <br /> Agenda Item:4(a) <br /> Background: The City Council approved the preliminary plat of RV Resort Village at the <br /> February 2007 meeting. This subdivision will create 172 lots.Of those,168 are for RV units,one <br /> is for a community building, one for a sales building, one for a caretaker, and a final lot for <br /> common space. <br /> The final plat is the last step in the subdivision process. <br /> Applicable Statutes: To obtain final plat approval, an applicant must fulfill the final plat <br /> requirements contained in the Ordinance and must also meet any conditions imposed by the <br /> City during the preliminary plat approval. The applicant received approval of the preliminary <br /> plat in February,subject to the following conditions: <br /> 1. The resort shall develop an internal permitting process to monitor improvements to the <br /> sites that would increase the amount of impervious coverage. Overall impervious <br /> coverage shall not exceed an average of 1,500 square feet per site. The location of <br /> impervious areas shall not be allowed to exceed the design standards for any of the <br /> drainage areas. A report on impervious coverage shall be submitted to the City annually <br /> for review. This program shall be established within the covenants for this development. <br /> The covenants, including this program, shall be reviewed during the final plat process <br /> and shall be modified at that time as per the direction of the Planning Commission. <br /> 2. The private road may only be utilized by the occupant of Lot 1, except in an emergency <br /> situation where there shall be no restriction. <br /> Section 11.9, Subdivision 6C outlines the procedure to follow when reviewing a final plat <br /> application and directs the Planning Commission to consider the following: <br /> 1. Has the applicant complied with all conditions and requirements upon which the <br /> preliminary approval is expressly conditioned wither through performance or execution <br /> of appropriate agreements assuring performance? <br /> 2. Does the Final Plat or Final Condominium Plat agree with the Preliminary Plat or <br /> Preliminary Condominium Plat? <br /> g. Does the City Attorney agree that all parties with an interest in the property are shown as <br /> signers of the document? <br /> 4. Does the City Engineer agree that all improvements required are satisfactorily completed <br /> or are guaranteed by contract with adequate financial security? <br /> 5. Does an independent Professional Land Surveyor agree that the final document meets <br /> the statutory requirements? <br /> 6. Has financial security been posted in the appropriate amount? <br /> Staff Findings: The Staff provides the following findings of fact for consideration by the <br /> Planning Commission: <br /> 1.
