In
general, the Commission cannot deny a final plat unless the applicant will not or cannot meet
the final platting requirements or the conditions of the preliminary plat approval. The
Commission cannot impose additional conditions that do not fall directly within the guidelines
of the final plat or relate directly to conditions imposed in the preliminary plat.
The Commission also has the option to table the final plat to obtain additional information.
Staff Recommendation: We recommend that the application be tabled so that the review of
the title information and the development agreement can be completed.
It should be noted that the Park Board has recommended that the applicant submit a park
dedication fee of $17,740.80. This fee was derived using a formula that had been originally
discussed and was recommended by the Board at their February 8,2007,meeting.
City of Pequot Lakes Staff Report 1-2
April 19,2007
