There are currently approximately 31 retail sales
businesses operating in the DMU zone and only a handful of these are allowed without a
conditional use permit. Most retail uses would fall under the "Commercial use other"
category and require a Conditional Use Permit. The same would be true for a majority of
the 37 businesses which would be considered as service industry uses in the DMU zone.
Additionally, a business relocating within the DMU would often need a Conditional Use
Permit, even if that business has been operating within the DMU for years.
The Downtown Mixed Use Zone is defined as follows
Section 17-5.12 DOWNTOWN MIXED USE(DMU)
1. Purpose and Intent:To provide a zoning classification for a mix of high-
density residential and commercial uses.Development in this zone relies less on
automobile traffic and more on walking, biking and other similar modes of
transportation. Infrastructure must be in place to provide on-street parking and
walkways as well as connection to municipal water and sanitary sewer utilities.
Downtown Mixed-Use zones should be clustered to provide the maximum
amount of interaction and accessibility between the different establishments.
The following list summarizes the differences between the Land Use Matrix and the
existing conditions in the DMU zone.
Land Use Matrix Existing Businesses
Animal Grooming(P) Building Services-(Painting,lumber,ect.)
Artist Studio(P) Entertainment-(Athletic rental)
Bed and Breakfast(C) Financial Services-(Banking,ect)
Child Care Center(P) Government-(City,Education,ect)
Church(C) Health Services-(Dentist,medical,ect.)
Commercial Use other(C) Hospitality-(Food,restaurant,ect.)
.,, Group care facility(P) Industrial-(Manufacturing)
Home occupation 3 and 4(A) Real Estate-(Investment)
Hotel(P) Retail Sales-(31 different ones)
Motel(P) Service-(37 different ones)
Nursery(P)
Nursing Home(P)
PUD Commercial or Res(C)
Resort(C)
Restaurant(P)
v Pequot Lakes Staff Report 7(a)-1
May 15,2oo8
