St. Louis Park, MN 55426 Re: City of Pequot Lakes Potential Ordinance Violation PIN: 291240040160009 Dear Ms. Dwight: It has come'to our attention through a complaint that you are likely in violation of the City's Ordinance regarding Dirtmoving, Grading and Filling in Shoreland Areas. The Ordinance states, in Section 25.090 B 1 (Dirtmoving in the Shore Impact Zone— SIZ) subpart d, that "In wetland areas in the Shore Impact Zone, no fill or drtmoving will be allowed" The Ordinance further states,in Section 25.090 B 2 (Dirtmoving in the Construction Impact Zone—CIZ) subpart c,that "In wetland areas: up to 400 square feet of fill, one time cumulative, will be permitted with an approved SWCD inspection form completed. " The Ordinance further states,in Section 25.090 B 3 (Dirtmoving in the Rear Lot Zone— RLZ) subpart c,that "In wetland areas: up to 400 square feet of fill, one time cumulative, will be permitted with an approved SWCD inspection form completed. " The Ordinance further states, in Section 25.090 B 3d, that "If not all 400 sq.ft. is utilized in the CIZ or RLZ, the balance may then be used in either zone. Only 400 sq.ft. cumulative shall be allowed in the Shore Impact Zone through Rear Lot Zone. " A previous owner had obtained permission from the Crow Wing County Soil and Water Conservation District(SWCD)to fill a 10' X 40' area. A subsequent owner placed a substantial amount of fill and was issued a Restoration Order to return the area to the permitted 10' X 40'.
