4. The applicant has not submitted a title opinion. <br /> 5. No improvements are required for this subdivision. <br /> 6. The applicant has not submitted a final plat check. <br /> 7. There is no need to post financial security for this subdivision. <br /> Planning Commission Direction: The Planning Commission should develop findings to either <br /> approve or deny the final plat. In general,the Commission cannot deny a final plat unless the <br /> applicant will not or cannot meet the final platting requirements or the conditions of the <br /> preliminary plat approval. The Commission cannot impose additional conditions that do not fall <br /> directly within the guidelines of the final plat or relate directly to conditions imposed in the <br /> preliminary plat. <br /> The Commission also has the option to table the final plat to obtain additional information. <br /> Staff Recommendation: Based on the findings of fact presented in this report,the Staff <br /> recommends that this final plat application be tabled until the following conditions are met: <br /> 1. The applicant shall submit a current title opinion for this subdivision within 60 days that <br /> is acceptable to the City Attorney. <br /> 2. The applicant shall submit a plat check within 60 days. <br /> 3. The applicant shall file a deed restriction indicating that the pole building shall be <br /> removed when Oak Street is improved. <br /> 4. The applicant shall remedy the gap on the eastern boundary of the property prior to <br /> resubmitting the final plat application. <br /> The applicant shall be required to pay a park dedication fee upon completion of the final plat. <br /> June Staff Report 2-2 <br />
