STAFF REPORT <br /> Application: Final Plat of Sibley Acres <br /> Applicant: William Wortham <br /> Background Information: The property is located just north of downtown between Highway <br /> 371 and Sibley Lake. The Planning Commission recommended approval of the preliminary plat <br /> of Sibley Acres at the October 2004 meeting. The preliminary plat was approved by the City <br /> Council in February with conditions. This final plat application is the final step in the subdivision <br /> process. <br /> Applicable Statutes: To obtain final plat approval, an applicant must fulfill the final plat <br /> requirements contained in the Ordinance and must meet any conditions imposed by the City <br /> during the preliminary plat approval. The preliminary plat for this subdivision was approved with <br /> the following conditions: <br /> 1. A deed restriction appears that the pole building will be removed when Oak Street is <br /> improved. <br /> 2. The gap be taken care of before moving to Final Plat and not at the City's expense. <br /> 3. Rezone the parcel to residential prior to Final Plat application. <br /> Section 140.040 of the Ordinance outlines the procedure to follow in reviewing a final plat <br /> application. The Planning and Zoning Board shall review the reports of the Attorney, Engineer, <br /> and Zoning Administrator and shall make a recommendation to the City Council. The Planning <br /> and Zoning Board shall consider the following: <br /> a. Has the applicant complied with all conditions and requirement upon which the <br /> preliminary approval is expressly conditioned, either through performance or execution <br /> of appropriate agreements assuring performance? <br /> b. Does the Final Plat agree with the Preliminary Plat? <br /> c. Does the City Attorney agree that all parties with an interest in the property are shown as <br /> signers of the document? <br /> d. Does the City Engineer agree that all improvements required are satisfactorily completed <br /> or are guaranteed by contract with adequate financial security? <br /> e. Does an independent professional land surveyor agree that the final plat meets the <br /> statutory requirements? <br /> £ Has financial security been posted in the appropriate amount? <br /> Staff Findings: Based on the information provided with this application,the Staff provides the <br /> following findings of fact for your consideration: <br /> 1. The gap on the east side of the property does not appear to have been taken care of prior <br /> to this final plat application. <br /> 2. The rezoning was approved by the Planning Commission at this meeting. <br /> 3. The final plat agrees with the preliminary plat in lot configuration. The cul-de-sac <br /> included on the approved preliminary plat has been amended to be a rectangular shape. <br /> This change was presented, discussed, and approved at the April Planning Commission <br /> meeting. <br /> June Staff Report 2-1 <br />
