STAFF REPORT <br /> Application: Conditional Use Permit for Retreat Rental Space (accessory apartment) <br /> Applicant: Lori Westlund <br /> Background: The Westlund property is located just east of Highway 371 on Government Drive. <br /> The property is 7100 square feet in size and is zoned Exempt Commercial. <br /> Ms. Westlund proposes to construct a commercial building (40' x 96')that would house a retail <br /> scrapbooking store on the first floor with a retreat rental space on the second floor. Ms. Westlund <br /> also proposed to include an area for seven parking spaces in front of the building. The existing <br /> Ordinances do not directly provide for transient residential rental uses in an Exempt Commercial <br /> zone, and so the proposed use would require a conditional use permit. <br /> Applicable Statutes: In addition to meeting the provisions of the Exempt Commercial zoning <br /> district, the application must also meet the provisions of a conditional use permit. To approve a <br /> Conditional Use Permit, the Planning Commission must also consider the following items: <br /> 1. The maintenance of the public health, safety and welfare. <br /> 2. The location of the site with respect to existing and proposed access roads. <br /> 3. Its compatibility with adjacent land uses. <br /> 4. Its compatibility with the intent of the zoning district in which such use is proposed. <br /> 5. Its compatibility with the objectives of the current Ordinance and its consistency with <br /> the current comprehensive land use plan. <br /> Further, the Ordinance directs that the Commission evaluate the effects of the proposed use on: <br /> 1. The prevention and control of water pollution, including sedimentation and nutrient <br /> loading. <br /> 2. Existing topography and drainage features and vegetative cover on the site. <br /> 3. The erosion potential of the site based upon the degree and,direction of slope, soil <br /> type, and existing vegetative cover. <br /> 4. The need for the proposed use for a shoreland location. <br /> 5. The amount of liquid waste to be generated and the adequacy of the proposed sewage <br /> treatment system. <br /> 6. The visibility of structures and other facilities as viewed from public waters. <br /> 7. Adequacy of the site for water supply and on-site sewage treatment systems. <br /> 8. The types, uses, and numbers of watercraft that the project will generate in relation to <br /> the suitability of public waters to safely accommodate these watercraft. <br /> Staff Findings: Based on the application and information provided,the Staff provides the <br /> following findings: <br /> I. The property is properly zoned for commercial use as it is zoned Exempt <br /> Commercial. <br /> 2. The property meets the minimum lot width of 50 feet. There is not a minimum lot <br /> size in the Exempt Commercial zone. <br /> 3. The proposed use meets the impervious coverage limit of 75 percent, having <br /> approximately 54 percent impervious coverage. <br /> April Staff Report 1-1 <br />
