(b) A non-exclusive easement to construct, maintain, install, repair, and replace septic <br /> systems, wells, waterlines, gas, electric, telephone, satellite or cable television and other utility lines <br /> which may or may hereafter serve such Lot in the locations; the same shall be initially constructed or <br /> installed by the Declarant, in locations designated by Declarant, or such other location as may be later <br /> approved, by the Board of Directors of the Association. <br /> (c) An exclusive easement in favor of each Lot to maintain any encroachment by fireplaces, <br /> roof overhangs, air conditioning equipment, flower boxes, decks, balconies or other appurtenances <br /> which are a part of the original construction of any Unit or which are altered or added pursuant to the <br /> Provisions of Article VIII hereof. <br /> (d) A non-exclusive easement for the use and enjoyment of those portions of the Common <br /> area developed for docks, boat launches, beach areas, open space,;,recreational or vehicular parking <br /> purposes. <br /> (e) A non-exclusive easement for emergency access or emergency maintenance by <br /> governmental authorities with subsequent reimbursement by the Association, if appropriate. <br /> Section 2. Extent of Members'Easements. TW tight and easement ift favor of the Lots and the <br /> Owners created hereby and the title of the Association to a#Common Area, shall be subject to the <br /> following and as further provided herein: <br /> (a) The right of the Association, a from in its Articles and Bylaws, to borrow moneys <br /> for the purpose of improving, repairing, and nointaining the Common Area, or any improvements <br /> thereon, and in aid thereof to mo prop�ies, provided that the rights of such mortgagee in <br /> said properties shall be subor ' e to tl*rights W the Members hereunder, and provided, further, <br /> that the requisite consent under Article X11 have been first obtained. <br /> (b) The rigIg Otte;Association to take such steps as are reasonably necessary to protect <br /> the Common Area agost forecl+qpqre; <br /> (c) The ng.:,of the Association, as provided in its Bylaws, to suspend the voting and <br /> enjoyment rights of any*embed ' r any period during which any assessment remains unpaid; <br /> provided, however,that n :i ntained in this subparagraph(c) shall be deemed to deny an Owner <br /> access to and from his or her Lit in Wilderness Resort Villas_ <br /> (d) The right of the Association, as provided in its Bylaws, and from time to time,to adopt <br /> reasonable regulations regarding the use and enjoyment of the Common Area. <br /> (e) The right of the Association so long as construction on, and initial sales of Lots shall <br /> continue, to create easements upon, across, over and under the Common Area for ingress, egress, <br /> installation, replacing, repairing, maintaining satellite or cable television antenna systems, security <br /> and similar systems, docks, walkways and all utilities, including but not limited to, water, septic, <br /> telephone, gas and electricity. The Board of Directors shall, upon written request of the Declarant, <br /> grant such easements as may be reasonably necessary for the development of any part of the <br /> Properties. <br /> 7 <br />
