The City of Pequot Lakes Land Use Ordinance defines a Commercial PUD as: <br /> Uses that provide transient, short-term lodging spaces, rooms or parcels with primarily <br /> service-oriented operations. Hotel/motel accommodations, bed and breakfast <br /> accommodations, resorts, recreational vehicle and camping parks, and other primarily <br /> service-oriented activities are examples of commercial planned unit developments. <br /> Applicable Statutes: Ordinances applicable to this application are listed below, drawn <br /> directly from the Pequot Lakes Land Use Ordinance. <br /> Section 170.050: Conditional Use Permits <br /> A. In considering the granting of any conditional use permit throughout the City,the <br /> Planning and Zoning Commission and City Council shall evaluate the effect of <br /> the proposed use upon: <br /> 1. The maintenance of the public health, safety and welfare. <br /> 2. The location of the site with respect to existing and proposed access roads. <br /> 3. Its compatibility with adjacent land uses. <br /> 4. Its compatibility with the intent of the zoning district in which such use is <br /> proposed. <br /> 5. Its compatibility with the objectives of this Ordinance and its consistency <br /> with the Comprehensive Plan. <br /> B. In considering the granting of any conditional use permit in shoreland areas, the <br /> Planning and Zoning Commission and City Council shall evaluate the effect of <br /> the proposed use upon: <br /> 1. The prevention and control of water pollution, including sedimentation <br /> and nutrient loading. <br /> 2. Existing topography and drainage features and vegetative cover on the <br /> site. <br /> 3. The erosion potential of the site based upon the degree and direction of <br /> slope, soil type and existing vegetative cover <br /> 4. The need for the proposed use for a shoreland location. <br /> 5. The amount of liquid waste to be generated and the adequacy of the <br /> proposed sewage treatment system. <br /> 6. The visibility of structures and other facilities as viewed from public <br /> waters <br /> 7. Adequacy of the site for water supply and on-site sewage treatment <br /> systems. <br /> 8. The types, uses and numbers of watercraft that the project will generate in <br /> relation to the suitability of public waters to safely accommodate these <br /> watercraft. <br /> C. Upon consideration of the factors listed above,the Planning and Zoning <br /> Commission may attach such conditions, in addition to those required elsewhere <br /> February Staff Report Page 6 <br />
