STAFF REPORT <br /> Application: Conditional Use Permit for a commercial Planned Unit Development in the <br /> Waterfront Commercial zone. <br /> Applicant: Wilderness Point Resort, LLC <br /> Background: Wilderness Point Resort is proposing to expand the existing resort, which <br /> is located on the northern shore of Middle Cullen Lake in the Waterfront Commercial <br /> _ Zoning District. The application is in three parts. This report reviews the conditional use <br /> permit application for the planned unit development, which establishes the concept and <br /> the mechanisms for how the development is to operate in the future. <br /> The development concept being proposed includes a rent-back ownership structures <br /> where investors purchase individual cabins. Both the cabin and the land immediately <br /> under the cabin are sold. The remaining common space is owned by all cabin owners and <br /> is managed by the resort association. As part of the rent-back contract, the investor is <br /> required to rent the cabin or condominium a certain number of weeks each year, with a <br /> concentration of those weeks during the summer. <br /> The individual cabins are managed as a resort with all resort features and amenities <br /> including an on-site resort manager. This arrangement continues in perpetuity with all <br /> future investors. <br /> Area of Interest <br /> Middle Cullen Lake <br /> Note:The parcel lines shown in this map may <br /> riot reflect changes due to outdated parcel data. <br /> A planned unit development (PUD) must meet all setback requirements of the underlying <br /> zone; however, a PUD is more flexible in where structures are allowed and the <br /> concentration of structures.
