2005 FARM LEASE AGREEMENT <br /> THIS AGREEMENT,made and entered into this day of , 2004, by <br /> and between the City of Pequot Lakes, hereinafter referred to as the "City" and Bill <br /> Tulenchik hereinafter referred to as "Tulenchik." <br /> Witnesseth, that said City, in consideration of the rents and covenants hereinafter <br /> mentioned to be paid and performed by Tulenchik, does hereby demise, lease, and let <br /> unto Tulenchik, and Tulenchik does hereby hire and take from the City the following <br /> described premise situated in the County of Crow Wing, State of Minnesota, to wit: <br /> 1. Description of Irrigated Property. The Property is legally described as follows: <br /> All that part of the Northwest quarter of the North 200 feet of the Southwest <br /> quarter of Section 23, Township 136 North, Range 29 West, Crow Wing County, <br /> MN lying East of the East right-of-way of the Minnesota Department of Natural <br /> Resources Paul Bunyan Trail. AND ALSO all that part of the West 100 feet of the <br /> Northwest quarter of the Northeast quarter of Section 23, Township 136 North, <br /> Range 29 West, Crow Wing County, MN. That said 105 acres may change from <br /> time to time over the course of this agreement as the City and Tulenchik may <br /> agree. <br /> 2. Description of Non-Irrigated Property. The above described includes 42 <br /> acres not being irrigated. <br /> 3. Term of Lease. This lease is for a term of two years beginning January 1, <br /> 2004 and ending December 31, 2005. Tulenchik shall be given the first right of <br /> refusal on the renewal of this contract at the end of the lease period on December <br /> 31, 2005. <br /> 4. Rent. Tulenchik shall pay to the City the sum of Three Thousand Dollars <br /> ($3,000) due on January 1, 2004, and January 1, 2005, for rent. <br /> 5. Crops and Condition of Lease. Tulenchik agrees to plant crops on the above <br /> described property. However, Tulenchik shall not plant or grow crops which need <br /> Nitrogen fertilizer. The soil shall be sampled annually and tested for nitrogen, <br /> phosphorus, and pot ash. Tulenchik is aware of, and will comply with Minnesota <br /> Pollution Control Agency (MPCA) Guidelines for spray irrigation sites, and the <br /> City retains the right to spray in the fall when needed from their sewage effluent <br /> plant. <br /> 6. Insurance. The City shall obtain and hold in effect an insurance policy <br /> covering damages and theft to the Center Pivot Irrigation System. Tulenchik shall <br /> obtain and hold in effect an insurance policy covering any damages or bodily <br /> injury he may cause. <br />
