their property, which would have greater environmental implications <br /> than placing it within the side-yard setback. <br /> 2. The applicants wish to protect trees along the lakeshore to the north, <br /> west and south of the existing cabin, and the proposed placement of the <br /> drain field reduces the amount of tree removal necessary, which is <br /> consistent with the intent and purpose of the Ordinance. <br /> 3. The proposed plan maintains or exceeds all other setback and <br /> impervious coverage requirements. <br /> 4. The applicant's proposal comes closer to meeting the intent of the <br /> Ordinance, which is to maintain the lake setback and protect lake water <br /> quality, than any other placement alternative or options available under <br /> the Ordinance. <br /> 5. The variance would not alter the essential character of the surrounding <br /> area; in fact, it retains screening and the northwoods feel by reducing the <br /> number of trees that would need to be removed. <br /> The Commission further recommends that the following conditions be included in <br /> a motion to approve the variance: <br /> 1. The applicants shall place the drain field as close to the center of the <br /> eastern property line (centering it at approximately 95.5' from north to <br /> south) as possible so as to reduce or eliminate any encroachment into <br /> the lake OHW setback to the north or south. Placement directly along <br /> the center of the lot line would meet all lake OHW setbacks. <br /> 2. The design does not show an alternate site for a drainfield. If the ISTS <br /> fails, applicant will be required to install an alternate system off-site or <br /> install a holding tank. <br /> 3. Preliminary Plat of Evergreen Third Addition. Mike Arvig, applicant. This <br /> is a request to re-plat a portion of the Evergreen development. The proposal takes <br /> existing duplex lots and spreads them out into eight single-family units. The units <br /> are serviced by clustered sewer and water systems. <br /> The Planning Commission is unanimously recommending that you approve the <br /> preliminary plat of Evergreen, Third Addition based on the following findings of <br /> fact: <br /> 1. The land is zoned Residential, which is the proper zoning for the type <br /> of subdivision requested. <br /> 2. There are no physical constraints indicated on the property that would <br /> limit residential development or require significant alteration of the <br /> land for residential development to proceed. <br /> 3. Soils are indicated to be very suitable for onsite sewage treatment. <br /> 4. The dwellings are to be served by a clustered sanitary sewer system. <br /> 5. Since this is part of a PUD, lot sizes are not a factor. The overall <br /> density was approved with the original PUD and does not increase <br /> with the proposed layout. <br />
