MOTION CARRIED 6-0. <br /> 7.1. Anderson Brothers — Call Special Meeting <br /> COUNCIL MEMBER BOLZ-ANDOLSHEK MOVED TO CALL A <br /> SPECIAL MEETING OF THE CITY COUNCIL ON JANUARY 11, 2005 <br /> AT 6:00 P.M. FOR THE PURPOSE OF HEARING THE APPEAL TO THE <br /> CONDITIONAL USE PERMIT FOR ANDERSON BROTHERS. COUNCIL <br /> MEMBER NAGEL SECONDED THE MOTION. MOTION CARRIED 6-0. <br /> 7.2. Right-of-Way (Old City Hall) <br /> The City Clerk indicated that the City's Attorney reviewed the issue and <br /> suggested that the City consider a permitting process for these types of <br /> right-of-way issues. She noted that approval can be given to Mr. Sutton <br /> contingent on future permitting procedures. <br /> COUNCIL MEMBER PFEIFFER MOVED TO APPROVE THE REQUEST <br /> BY MR. SUTTON TO LOCATE A CONCRETE SLAB, FENCE AND <br /> `-- GARBAGE CONTAINER ON THE CITY'S RIGHT-OF-WAY SUBJECT <br /> TO FUTURE PERMITTING PROCEDURES. COUNCIL MEMBER <br /> SJOBLAD SECONDED THE MOTION. <br /> David Kennedy spoke in opposition of the Council allowing the trash <br /> receptacle to be located in the City's right-of-way. <br /> COUNCIL MEMBER RYAN MOVED TO AMEND THE MOTION TO <br /> STATE THAT THE RIGHT-OF-WAY INFRINGEMENT CAN CONTINUE <br /> ONLY UNTIL A MORE SUITABLE PLACE WITHIN THE CONTEXT OF <br /> THE PROPERTY LINES CAN BE FACILITATED OR UNTIL THE CITY <br /> NEEDS THE RIGHT-OF-WAY. COUNCIL MEMBER NAGEL <br /> SECONDED THE MOTION. <br /> David Kennedy indicated he would also like to be permitted to place his <br /> garbage receptacle in the right-of-way along with Mr. Sutton. Council <br /> Member Ryan suggested that Mr. Kennedy work this out with Mr. Sutton. <br /> THE MOTION AS AMENDED CARRIED 6-0. <br /> The Council directed the Planning Commission to work on a right-of-way <br /> permitting process and also on a screening process for garbage <br /> �. receptacles. <br />
